Differentiated integration-farewell to the EU-27?

Opis: In light of the persisting economic crisis, momentum has been building in the European Union to embark, once again, on a path towards a more differentiated integration. The calls in favor of the so-called two-speed Europe have sounded increasingly loud and have come from diverse, but highly influential corners of European socio-political life. Against this backdrop, and with an eye to the historical experience with differentiated integration in the EU, this article examines the following: Just how plausible the emergence of a more differentiated Union actually is at this time; if plausible, what form such differentiated Union could take; and whether this development is normatively attractive or not.

Opis: This article examines the relationship between the concept of sovereignty and the process of European integration. It is argued that the nature of this relationship has been both mutually informative and transformative. As a particular understanding of sovereignty has influenced and determined the perception of European integration, i.e., its conceptualization, so the process of European integration has reflected back on sovereignty and entailed its rethinking. This poses a particular challenge for legal theorists: how to pin down the meaning of sovereignty and European integration so as to put both in the best conceptual and normative light. The article begins by looking at the traditional perspective on sovereignty and how this has been challenged by European integration. The focus then shifts from sovereignty to European integration in order to examine how different perspectives on sovereignty, when used as an epistemic lens for understanding the process of European integration, have produced uneven conceptions of this integration. Finally, the article concludes by making a choice between the various conceptions of sovereignty and European integration. It is argued that the best conception of European integration is offered by the constitutional form of a union founded on pluralist sovereignty

Pravno varstvo posameznika v upravnem pravu Evropske unije

Opis: Prispevek se osredotoča na upravno pravo EU, ki je ena od sodobnih pojavnih oblik upravnega prava in katerega obseg in pomen v zadnjih letih skokovito naraščata. Prispevek uvodoma opredeli, kaj upravno pravo EU sploh je. Temu sledi analiza ustvarjalcev upravnega prava EU, kakor tudi njegovih naslovnikov. V okviru teh je osrednja pozornost namenjena posamezniku. Predstavljeni so različni načini, kako upravno pravo EU vpliva na položaj posameznika in, z druge strani, kako lahko posameznik zavaruje svoje pravice in pravne interese v upravnih postopkih z evropskimi upravnimi organi. Prispevek sklene s kratko oceno pravnega položaja posameznika v upravnem pravu EU in z nekaj predlogi za njegovo izboljšavo.

Failed democracy : the Slovenian Patria case - (non)law in context

Opis: The paper discusses the role played by the Slovenian judiciary and its legal academic counterparts in the notorious Slovenian ‘Patria affair’. The affair led to the incarceration of the leader of the main Slovenian opposition party just three weeks before the parliamentary elections, turning the latter into an unfair and illegitimate event rather than an exercise in democracy. Due to the overall legal and political context of the affair, there is growing evidence to substantiate the belief that right from the outset the affair was politically motivated and used to instrumentalise, even abuse, the institutions of the rule of law for political purposes. With a special focus on the role of the Constitutional Court in this matter, the paper demonstrates the severity of the crisis of the rule of law in Slovenia, a country that is inevitably drifting into the group of de facto failed constitutional democracies.

Central Europe as a legal phenomenon

Opis: This article argues that Central Europe is not just a cultural but also a legal phenomenon. This is made explicit if law is approached through the integral conception of law, defended here. Pursuant to this conception: law is an institutional normative order that is both highly dependent on the (legal) culture, which it simultaneously frames. It is argued that history has inflicted many pathologies on the Central European culture and consequently on the law too. These pathologies, briefly illustrated on the Slovenian example, form part of the broader Central European legal malaise. This can be addressed successfully only through the veritable regional cooperation of Central European countries that partake of these legal challenges. To do so, an appropriate forum is needed. The Visegrad Group comes across as a natural and best suited candidate. However, due to its self-conceived political exclusivity this option appears to be foreclosed. Paradoxically, in so doing, the Visegrad Group is defeating the very objectives for which it has been created. The article thus concludes that the Visegrad Group has to enlarge to stay faithful to its own values, which also, and in the first place, mandate the eradication of the Central European legal malaise.

Pravo EU in nacionalna procesna avtonomija

Opis: Avtor v prispevku analizira teoretični in praktični pomen načela nacionalne procesne avtonomije v pravu EU. Po uvodni opredelitvi samega pojma so predstavljeni razlogi za obstoj nacionalne procesne avtonomije in njene omejitve. Te so dveh vrst: zakonodajne in sodne. Predvsem sodne omejitve so zelo razvejane in večkrat tudi ne povsem koherentne in predvidljive. V prispevku se zato osredotoči nanje, tako da predstavi najnovejšo sodno prakso Sodišča Evropske unije na petih najbolj izpostavljenih področjih nacionalne procesne avtonomije. V zaključku so povzete temeljne ugotovitve in predlagane smeri razmisleka o normativnih izboljšavah dejanskega stanja.

Global constitutionalism as a grammar of global law?

Opis: The article examines the viability and the desirability of the use of constitutional grammar on the global plane. It asks whether global constitutionalism is a viable and/or desirable concept that should be theoretically (and later practically) invested in to know and to understand better the phenomenon of global law as well as, potentially, to come up with normatively advantageous outcomes. The argument is broken down into three parts. The first conceptual part contains a study of the conventional meaning of constitutionalism and global law. This is followed by an examination of the descriptive, explanatory and normative fit between the two phenomena. The final part passes a verdict on the viability and desirability question. It is argued that constitutionalism is only a part of the grammar of global law, its morphology, while principled legal pluralism acts as its syntax.

Rule of Law and the Economic Crisis in a Pluralist European Union

Opis: By way of introduction to the special issue, the article’s objective is threefold. First, it conceptually re-examines the often assumed correlation between the rule of law and economy. Secondly, it situates this conceptual relationship in the present crisis-ridden context of the European Union as synthesized in the contributions to the special issue. By so doing, it demonstrates that due to the EU’s pluralist nature, the economic and rule of law crises have had very different faces and consequences in different member states. Despite that the article in conclusion nevertheless tries to identify the shared patterns of the crisis and, in the inevitable absence of a single way of improving the situation, proposes at least a common one.

The UN, the EU, and the Kadi Case : a new Appeal for Genuine Institutional Cooperation

Opis: While the Kadi affair has attracted a lot of attention, this Article approaches it from a rarely used contextual theoretical perspective of resolving instituti onal conflicts through reflexive sincere cooperation. The argument is short and simple: The institutional relationship between the EU judiciary and the UN Security Council should have been conducted not in strategic-pragmatic terms motivated by institutional power-plays, but rather by genuine pluralist institutional cooperation. The argument is preceded by an in-depth analysis of the theoretical and concrete practical shortcomings stemming f rom the lack of institutional cooperation between the UN and the EU in the Kadi affair. Thes e shortcomings were not inevitable, as the EU and the UN legal and political system s are already connected with a whole set of bridging mechanisms. These should be, however , strengthened and their use should be made more common. In order to achieve that, the A rticle suggests an amendment to the Statute of the Court of Justice of the EU and further improvement of the safeguards in the UN Security Council sanctioning mechani sms procedures. There is no dilemma: Enhanced institutional cooperation between the institutio ns of the two systems will work to their mutual advantage as well as, most imp ortantly, maintain the rights and liberties of individuals like Kadi

Constitutional and Administrative Pluralism in the EU System of Banking Supervision

Opis: This Article examines the relationship between the developing European Union (EU) system of banking supervision and the theories of constitutional pluralism. It questions the remaining epistemic, explanatory, and normative value of these theories with regard to the EU system of banking supervision. The argument is broken down into three parts. First, the Article briefly describes the system of banking supervision in the European Union and the pluralist challenges that it spurs. Second, it schematically maps out the leading theories of constitutional pluralism to test, by way of their application to the field of EU banking supervision, their epistemic, explanatory, and normative value. Finally, to the extent that this value has diminished, the Article offers another pluralist theory, not a constitutional one, which could supplement the identified epistemic, explanatory, and normative gaps. This is a theory of administrative pluralism.
