Opis:Diplomska naloga Zaposlitveni postopek v slovenski zakonodaji analizira pravne zahteve, ki urejajo zaposlovanje v Sloveniji. Poudarek je na Zakonu o delovnih razmerjih (ZDR-1), ki je temeljni pravni akt za urejanje delovnih razmerij in s tem vključujoče dejavnosti. Zakon določa pravice in obveznosti delodajalcev in delavcev ter ureja vse faze zaposlovanja. Postopek zaposlovanja se začne s pripravo in objavo razpisa za delovno mesto, kjer je naloga delodajalca, da so pogoji zaposlitve jasni in nediskriminatorni. Sledi zbiranje prijav kandidatov, pri čemer je treba spoštovati varnost osebnih podatkov. Delodajalec mora zagotoviti, da so vsi kandidati obravnavani enakopravno, brez diskriminacije na podlagi osebnih lastnosti in okoliščin kandidatov (spol, starost, narodnost, vera ipd.). Po prejemu prijav sledi izbor kandidatov, ki vključuje preučitev življenjepisov, izvajanje psihometričnih testov in različnih vrst razgovorov. Ko je kandidat izbran, sledi sklenitev pogodbe o zaposlitvi. Zakon (ZDR-1) določa, da mora biti pogodba pisna in mora vsebovati vse bistvene elemente, kot so plačilo, delovni čas, opis delovnega mesta in trajanje zaposlitve. Zadnji korak je uvajanje novega zaposlenega v delovno okolje, ki vključuje seznanitev z delovnimi nalogami, pravili in kulturo podjetja ter zagotavljanje ustreznega usposabljanja, če je treba. Celoten zaposlitveni postopek traja veliko časa in je natančno predpisan, kako naj bi potekalo zaposlovanje. Če nastanejo nesoglasja in spori med delodajalcem in delavcem, povezani z zaposlitvenim postopkom, zakonodaja omogoča načine njihovega reševanja, vključno z mediacijo, arbitražo in sodnim postopkom. Tako zaposlovanje v slovenski zakonodaji zagotavlja pošteno in zakonito obravnavo vseh udeležencev zaposlitvenega postopka

Opis:The thesis Employment Procedure in Slovenian Legislation analyzes the legal requirements governing employment in Slovenia. The focus is on the Employment Relationships Act (ZDR-1), which is the fundamental legal framework for regulating employment relationships and related activities. The Act defines the rights and obligations of employers and employees, covering all stages of the employment process. The employment procedure begins with the preparation and publication of a job vacancy, where the employer’s responsibility is to ensure that the employment conditions are clear and non-discriminatory. This is followed by the collection of applications from candidates, while ensuring the protection of personal data. The employer must ensure that all candidates are treated equally, without discrimination based on personal characteristics or circumstances (e.g., gender, age, nationality, religion, etc.). After receiving the applications, the selection process follows, which involves reviewing resumes, conducting psychometric tests, and various types of interviews. Once a candidate is selected, an employment contract is signed. The Act (ZDR-1) stipulates that the contract must be in writing and include all essential elements, such as remuneration, working hours, job description, and the duration of employment. The final step is the onboarding of the new employee into the work environment, which includes familiarization with job tasks, company rules and culture, and providing necessary training, if required. The entire employment procedure is time-consuming and strictly regulated in terms of its course. In case of disputes or disagreements between the employer and employee regarding the employment procedure, the legislation provides methods for resolving these issues, including mediation, arbitration, and court proceedings. Thus, employment under Slovenian legislation ensures fair and legal treatment of all participants in the employment process
