Title:Ureditev starostnih pokojnin v Evropski uniji : magistrsko delo

Abstract:Magistrska naloga vsebuje pregled področja starostnih pokojnin v državah članicah Evropske unije. Osredotoča se na zakonsko ureditev starostnega pogoja, dobe plačanih pokojninskih prispevkov in druge pogoje, ki omogočajo prejemanje polne starostne pokojnine tistim, ki so te omejitve izpolnili. Naloga povzema tudi reforme, ki so jih države članice v zadnjem obdobju implementirale v socialno zakonodajo, ki pokriva starostne pokojnine, ter ključen razlog za reformiranje tega področja, ki je negativna demografska slika prebivalstva Evropske unije.Začetni del naloge opisuje razvoj socialnega varstva v Evropi s poudarkom na pokojninah. V tem sklopu je opisana delitev evropske socialne varnosti na tri različne sisteme, ki imajo danes velik vpliv na financiranje starostnih pokojnin. Evropska unija kot skupnost večine evropskih držav se s pogostimi ukrepi in vzvodi intenzivno trudi ohraniti socialne standarde, ki jih najrazvitejše članice v skupnosti danes dosegajo.Osrednji del naloge vsebuje pregled trenutne zakonske ureditve držav članic Evropske unije in Slovenije na področju starostnih pokojnin. Predstavljene so tudi reforme tega področja, ki jih posamezne članice že izvajajo in reforme,ki so v nekaterih državah še napovedane. Zadnji sklop naloge povzema učinkovite reforme in s tem rešitve na področju starostnih pokojnin, ki so jih izvedle druge države članice EU ter primere kako bi lahko Slovenija izkušnje drugih članic na področju reformiranja starostnih pokojnin implementirala v prihajajočo pokojninsko reformo.

Abstract:This master's thesis deals with old-age pensions in the European Union member states. In particular, it focuses on how the age condition for retirement; the length of the time during which pension contributions are paid; and other conditions which have to be met in order for a person tobe eligible to receive full old-age pension are legally regulated. Moreover, the reforms recently undertaken by the member states in their social legislations regulating old-age pensions along with the key reason for reforms in this area, i.e. the negative demographic trends in the European Union, are presented. The first part presents the development of social security in Europe with a special emphasis on pensions. It is shown how European social security is composed of three different systems whose impact on the financing of old-age pensions today is significant. By taking a number of different measures, the European Union, which comprises the majority of the European countries, tries intensively to preserve the social standards set by the most developed member states. The central part presents the currently applicable legal regulation of old-age pensions both in the EU member states and in Slovenia. The respective reforms which are presently being implemented by individual member states and those announced by some other states are discussed. The last part brings a summary of efficientreforms, i.e. solutions, in the field of old-age pensions which have so far been carried out by the other EU member states. Several suggestions are given as to how Slovenia could include other member states' experiences in the field of reforming old-age pensionsin the upcoming pension reform.
