Title:Razmerje med splošnim in posebnimi upravnimi postopki s posebnim poudarkom na postopku ugotavljanja stalnega prebivališča : magistrsko delo

Abstract:Magistrska naloga obravnava teoretično pravno razmerje med splošnim in posebnimi upravnimi postopki ter izvajanje posebnega upravnega postopka - ugotavljanje stalnega prebivališča posameznika, težave s katerimi se srečujejo uradne osebe pri vodenju postopka ter predstavitev možnih rešitev za čimbolj učinkovito vodenje in ekonomično reševanje postopkov. Splošni upravni postopek v Republiki Sloveniji ureja Zakon o splošnem upravnem postopku, ki se subsidiarno uporablja s specialnimi predpisi, ki urejajo posebne upravne postopke. Eden od teh je tudi Zakon o prijavi prebivališča, ki med drugim delno določa postopek ugotavljanja stalnega prebivališča. Postopek uvede in vodi upravna enota, kjer ima posameznik prijavljeno stalno prebivališče. Uradna oseba, ki postopek vodi, mora ugotoviti kje ta oseba prebiva oziroma ne prebiva, ter na podlagi zakonskih določb odločiti v postopku ali postopek ustaviti v skladu z Zakonom o splošnem upravnem postopku. Problem, ki ga izpostavljam v nalogi je neenotno vodenje tega upravnega postopka, nejasne določbe glede zakonskega prebivališča in pravice lastnika nepremičnine, kjer ima posameznik prijavljeno stalno prebivališče. Izboljšave tega postopka so možne na več nivojih. Rezultat teh izboljšav bi predstavljala predvsem enotna upravna praksa, ki bi jo pripravilo pristojno ministrstvo, saj na obravnavanem področju še ne obstaja, ampak jo upravni delavci postopoma ustvarjajo večinoma s svojimi odločitvami in medsebojno izmenjavo mnenj. Izboljšava trenutnega stanja je mogoča tudi s samo normativno ureditvijo postopka, kot je to primer v drugih predstavljenih posebnih upravnih postopkih, kjer so postopkovne določbe jasne in natančne.

Abstract:The master`s thesis deals with the theoretical legal relationship between general and special administrative procedures and the implementation of a special administrative procedure % determining permanent residence of an individual, the difficulties officials are meeting with this procedure and the presentation of possible solutions for the most efficient management and economical solving of procedures. The general administrative procedure in the Republic of Slovenia is governed by the General Administrative Procedure Act, which is applied in a subsidiary manner with special regulations governing special administrative procedures. One of these is also the Residence Registration Act, which, among other things, partly determines the procedure for determining permanent residence. The procedure is initiated and managed by an administrative unit where the individual is registered as a permanent resident. The official leading the procedure must determine where this person resides or does not reside and decide on the basis of the legal provisions or to stop the procedure in accordance with the General Administrative Procedure Act. The problem that I am emphasising is uneven management of the procedure, vague provisions regarding the legal residence and the right of the real estate owner where an individual has registered permanent residence. Improvements of this procedure are possible on several levels. The result of this improvements would represent unified administrative practice, compiled by the competent ministry, as it does not yet exist in this field, but it is rather created by the officials with the decisions they make and mutual exchange of views. The improvement of the current situation is also possible with a regulatory framework of the procedure, as is the case in other presented specific administrative procedures where procedural provisions are clear and precise.
