Title:Izbrisani pred ESČP : diplomsko delo

Abstract:Predstavljen je primer izbrisanih pred ESČP. To so bili državljani bivših jugoslovanskih republik, ki niso mogli pridobili slovenskega državljanstva. Ker so jim bile zaradi tega kršene človekove pravice, je velik del diplomskega dela posvečen tudi njim. Pri tem sem se osredotočila na njihovo varovanje v mednarodnem prostoru. Namen dela je bil predstaviti, kako pomembno vlogo ima ESČP nasploh in kako je primer izbrisanih vplival na spremembo slovenske zakonodaje. Uporabljena je bila sodna praksa ESČP in US ter slovenska osamosvojitvena zakonodajo, v katero spadajo TUL, UZITUL, ZDRS in ZTuj. Z njo je bila prikazana neurejenost položaja izbrisanih. Statuti mednarodnih organizacij, SDČP, EKČP, Evropska socialna listina, Evropska listina o temeljnih pravicah ter druge mednarodne konvencije so bili uporabljeni v poglavjih o človekovih pravicah. Primerjana je bila različna raven varovanja in kako jih posamezne organizacije sankcionirajo. Rezultati raziskave kažejo na visoko raven mednarodnopravnega varovanja človekovih pravic, še posebej očiten primer tega je ESČP. Njihov doprinos v primeru izbrisanih je bil ključen za ureditev njihovega položaja v Sloveniji. Prav tako je bil s pilotno sodbo storjen pomemben korak k vzpostavitvi odškodninske sheme. Izbrisani predstavljajo prelomen primer v sodni praksi ESČP na področju podeljevanja in urejanja državljanstva, vendar ker je to še vedno večinoma v pristojnosti držav, bodo šele naslednji primeri pred ESČP podrobneje opredelili standarde, ki jih bodo pri tem morale upoštevati države.

Abstract:The case of the erased before the ECHR is presented in my thesis. These were citizens of former Yugoslav republics that could not acquire Slovenian citizenship. Because this led to the violation of their human rights I dedicated a part of my thesis to them. I concentrated on their protection worldwide. My intention in this thesis is to present how important is the role of the ECHR in general and how the Slovenian legislation was affected by it in the case of the erased. In my thesis the case-law of the ECHR and the Institutional court of Slovenia was used as well as the Slovenian legislation that was created during the independence. With it was presented how unclear the legal status of the erased was during that period. Charters of international organisations were used as well as UDHR, ECHR, European Social Charter, Charter of Fundamental Rights of the European Union and other international documents in chapters about human rights. The difference in protection of human rights was compared and how various international organisations sanction the violations of human rights. Results of my research show that the protection of human rights is on a high level in international law. An example of this is also the ECHR. Its contribution was vital in the case of the erased when it came to the regulation of their legal status. Its test judgement was of great significance in creating a compensation scheme. The case of the erased before the ECHR was a breaking one in its case-law regarding granting and regulating citizenship. But because this area is still primarily under the authority of the countries following cases will further define standards that the countries will have to take in consideration.
