Title:Skupno in posebno premoženje zakoncev ob razvezi zakonske zveze : diplomsko delo

Abstract:Namen diplomskega dela je predstavitev premoženjskih razmerij med zakonci, s katerimi se soočajo ob razvezi zakonske zveze. S sklenitvijo zakonske zveze se posamezniku spremeni premoženjskopravni in osebnopravni status. Posledično zakonca vzpostavita medsebojno življenjsko skupnost, ki predstavlja podlago za nastanek določenih premoženjskih povezav. Ena od teh je premoženjska kategorija skupnega premoženja. Gre za skupek premoženjskih pravic, ki so pridobljene z delom ali odplačno v času veljavne zakonske zveze. Družinski zakonik ne določa, katere premoženjske pravice spadajo v skupno ali posebno premoženje zakoncev, temveč podaja le zakonski okvir, ki ga sodna praksa dopolnjuje primeroma. Osrednja problematika, s katero se zakonca soočata v primeru razveze zakonske zveze, je, kako bosta razdelila skupno premoženje, ki sta ga ustvarila v času trajanja zakonske zveze. Težave se pojavljajo, če zakonca nista sporazumna in se vsaj eden od njiju ne strinja z zakonsko pravno domnevo o enakosti deležev na skupnem premoženju. Pri tem nepravdno sodišče upošteva dejstvo, da skupno premoženje ni le računska operacija, zato lahko zakonca napoti na pravdo, kjer imata možnost dokazovanja drugačnega prispevka k skupnemu premoženju. V nasprotnem primeru pa velja, da posebno premoženje vsakega od zakoncev uživa enak status kot premoženje katerekoli osebe, ki ni poročena. Šteje se, da je bilo pridobljeno pred sklenitvijo zakonske zveze ali neodplačno, zato lahko zakonec z njim samostojno upravlja in razpolaga kot s samostojno lastninsko pravico.

Abstract:The purpose of the thesis is to present the matrimonial property regimes they face in the time of divorce. The marriage changes the individual's legal and personal legal status. As a result, the spouses establish a mutual life partnership which provides the basis for the formation of certain property connections. One of these is the property category of the common property. It is a set of property rights acquired by work or for payment during the current marriage. The Family Code does not specify which property rights fall within the spouses' common or specific assets, but provides only a legal framework which is supplemented by case-law. The central issue facing the spouses in the event of divorce is how they will divide the common property they have created during the marriage. Problems arise if the spouses are not consensual and at least one of them disagrees with the legal presumption of equality of shares in the common property. In doing so, the non-worthy court takes into account the fact that the joint assets are not only a computational operation and can therefore refer the spouses to a lawsuit where they have the possibility of proving a different contribution to the common property. Otherwise, the special property of each spouse shall be considered to enjoy the same status as that of any person who is not married. It is considered to have been acquired before the marriage or free of charge and the spouse may therefore manage and dispose of it independently as an independent right of ownership.
