Abstract:V diplomskem delu želimo predstaviti pojem narodnih manjšin ter podrobno opredeliti status nemško govoreče etnične skupnosti v Sloveniji. Osredotočili se bomo na vprašanje, ali lahko nemško govorečo etnično skupnost v Sloveniji štejemo pod pojem ‘narodna manjšina’ ali pa ima morda drugačen status. Ugotoviti želimo, katere pravice ji pripadajo in v kakšnem obsegu ter v čem se njihov položaj razlikuje od položaja ustavnopravno priznanih avtohtonih narodnih manjšin, kot sta madžarska in italijanska avtohtona narodna manjšina. Pri primerjavi se bomo osredotočili na položaj narodnih manjšin na slovenskem ozemlju in ga primerjali s položajem in statusom nemško govoreče etnične skupine v Sloveniji. Dotaknili se bomo tudi zgodovinskega položaja nemške narodne manjšine v Sloveniji in tudi njenega položaja danes. Podrobno bomo analizirali manjšinske pravice, ki pripadajo nemški narodni skupnosti, in njihov obseg. Izpostavili bomo pravice, za katere se nemška narodna manjšina v Sloveniji bori že vrsto let, in pa tudi manjšinske pravice, za katere menimo, da niso uveljavljene v celoti. Zaobjeli bomo ustavnopravno področje manjšinskega varstva in tudi manjšinsko varstvo v okviru raznih mednarodnih organizacij, kot so OZN, Svet Evrope, Evropska unija in OVSE.

Abstract:In the mentioned diploma thessis we want to present the concept of national minorities, and define in detail the status of the German-speaking ethnic community in Slovenia. We will focus on the question of whether the German-speaking ethnic community in Slovenia can be considered a ‘national minority’, or whether it may have a different status. We want to find out which rights belong to them and to what extent, and how their position differs from the position of constitutionally recognized autochthonous national minorities, such as the Hungarian and Italian autochthonous national minorities. In the comparison, we will focus on the position of national minorities on Slovenian territory and compare it with the position and status of the German-speaking ethnic group in Slovenia. We will also touch on the historical position of the German national minority in Slovenia, as well as its position today. We will analyze in detail the minority rights belonging to the German national community and their scope. We will highlight the rights that the German national minority in Slovenia has been fighting for for many years, as well as the minority rights that we believe are not fully established. We will cover the constitutional field of minority protection, as well as minority protection within various international organizations, such as the United Nations, the Council of Europe, the European Union and the OSCE.
