Abstract:Ena izmed najpomembnejših novosti, ki jih prinaša Zakon o obligacijskih razmerjih,oštevilčen z 6098, ki je bil sprejet 01.07.2012, je določba v zvezi s splošnimi pogoji procesa. Te določbe vsebujejo pomembne posege v svobodo naročila. Ker so določbe v zvezi s splošnimi pogoji procesa obligacijskega prava splošne, se uporabljajo v vseh pogodbenih razmerjih, razen če je predpisano drugače. V naši raziskavi smo razmislili in pripravili rezultate o pomenu predpisov v omenjenem Zakonu. Pripravili smo tudi kritikov zvezi z določbami in uporabo na Vrhovnem sodišču, preden se zakon uveljavi.One of the most significant innovations brought by the Law of Obligations numbered 6098 which was enacted on 01.07.2012 is the provisions regarding with general process conditions.These provisions contain important interventions on contract freedom. Since provisions regarding with general process conditions in Law of Obligations are general, they are applicable in all contract relations unless there is a regulation otherwise. In our study, meaning of the regulations in the Law and thoughts about its possible results are shared, starting from the statements regarding with the term of general process condition. Also, criticisms regarding with provisions and Supreme Court application related to the subject before the Law is put into force.
