Abstract:
Magistrsko delo v celoti obravnava koncept človekovega dostojanstva kot prirojene in neodtujljive vrednosti vseh človeških bitij, ki mora biti priznana, spoštovana in zaščitena s strani drugih posameznikov, države in celotne družbe. V zadnjih nekaj desetletjih je človekovo dostojanstvo postalo ena izmed najbolj pomembnih idej v sodobnem pravu človekovih pravic. Ideja o človekovem dostojanstvu se je začela razvijati že v antiki in se je skozi zgodovino obravnavala na različnih področjih od filozofije, religije in se nazadnje vpletla v mednarodne in nacionalne pravne sisteme. Posledično je koncept dostojanstva zelo ohlapen in ima v različnih kontekstih lahko zelo različno vsebino. Človekovo dostojanstvo ima danes temeljno vlogo v številnih mednarodnih dokumentih o človekovih pravicah, v ustavah posameznih držav in v sodni praksi mednarodnih in nacionalnih sodišč. V ustavah posameznih držav je človekovo dostojanstvo lahko obravnavano kot človekova pravica, kot ustavna vrednota ali oboje. Sodna praksa je namreč edini vsebinski vir, ki prikaže, na kakšen način je človekovo dostojanstvo povezano s človekovimi pravicami. V magistrskem delu je prikazana mednarodna sodna praksa na temo človekovega dostojanstva Evropskega sodišča za človekove pravice, Ameriškega sodišča za človekove pravice in sodišča Afriške Unije v povezavi z določenimi človekovimi pravicami. Prav tako je prikazana primerjava sodne prakse posameznih držav: Vrhovnega sodišča Združenih držav Amerike, Vrhovnega sodišča Kanade, Ustavnega sodišča Slovenije, Zveznega ustavnega sodišča Nemčije, Ustavnega sodišča Južne Afrike in Vrhovnega sodišča Izraela.

Abstract:
This master degree's thesis is dealing with the entire concept of human's dignity as congenital and inalienable value of all human beings, which must be acknowledged, respected and protected by other individuals, states and entire society. Over the last few decades, human dignity has become one of the most important issue in the contemporary law of human rights. The concept of human dignity existed already in the ancient times and has been taken into consideration through different fields of philosophy, religion and has been drawn in into international and local legal systems. Consequently, the concept of dignity is very loose and has various meaning in various contexts. Today, the human dignity has a fundamental role in a number of international documents on human rights, in constitutions of individual states and in case-laws of international and national courts. The constitution of individual states considers the human dignity as a human right, or a constitutional value, or both. The court practices are the sole contextual source, which shows in what manner the human dignity is related to the human rights. This master degree's thesis shows international court practices on the human dignity cases of the European Court for Human Rights, American Courts for Human Rights and the courts of African Union in respect to the specific human rights. The thesis also shows the comparison of court practices in individual state.; the Supreme Courts of the United States of America, the Supreme Courts of Canada, The Supreme Court of Slovenia, The Federal Constitutional Court of Germany, the Constitutional Court of the South Africa and the Supreme Court of Israel.
