Abstract:Predmet obravnave monografije je pravni institut finančnih popravkov, ki se nanaša na različne pravne postopke finančnega korigiranja (domnevnih) napak pri dodeljevanju oz. porabi sofinancerskih sredstev iz EU-skladov. Delo zajema tri vsebinske sklope: V prvem delu, tj. v poglavju »Opredelitev in sistemska umestitev finančnih popravkov«, knjiga najprej opredeli termin finančnih popravkov ter ga obravnava tudi v kontekstu širšega teleološkega vidika. Nadalje pa zadevni institut vsebinsko umešča v kontekst proračuna EU oz. njegovih (proračunskih) skladov ter ga identificira kot del sistema upravljanja in nadzora v sistemu deljenega upravljanja sredstev proračuna EU s strani Evropske komisije in držav članic. Naslednje poglavje, »Finančni popravki Evropske komisije«, se osredotoča na postopke uveljavljanja finančnih popravkov Evropske komisije v razmerjih do držav članic. Skozi prizmo predvsem sodne prakse Sodišča EU so v tem poglavju vsebinsko obravnavani posamezni sklopi pravnih vprašanj, ki jih to delo evidentira kot ključne za razumevanje pravnega ustroja obravnavanega inštituta finančnih popravkov. Poglavje »Finančni popravki države članice (Republike Slovenije)« pa nato zajema razpravo glede več pravnih aspektov razumevanja in aplikacije obravnavanega pravnega instituta tudi in predvsem v dosedanji sodni praksi slovenskih nacionalnih sodišč.

Title:Financial Corrections of European Union Funds
Abstract:The monograph examines the legal concept of financial corrections, which concerns the procedures used to address (alleged) irregularities in the allocation and use of EU co-financing. The book is structured into three main parts. The first chapter, “Definition and Systemic Positioning of Financial Corrections,” clarifies the concept of financial corrections and explores its broader purpose and underlying rationale. It then places the institute within the framework of the EU budget and its funds, identifying it as an integral part of the management and control system operating under the shared management of EU budget resources by the European Commission and the Member States. The second chapter, “Financial Corrections by the European Commission,” focuses on the procedures through which the European Commission imposes financial corrections in its relations with Member States. Drawing in particular on the case law of the Court of Justice of the European Union, the chapter analyses the key legal issues that are essential to understanding the legal framework governing financial corrections. The final chapter, “Financial Corrections by the Member State (Republic of Slovenia),” discusses the main legal aspects of the interpretation and application of this institute at national level, with particular attention to the existing case law of Slovenian courts.
