Title:Ex ante pristup nacionalnih regulatornih tijela u procesu regulacije telekomunikacijskog tržišta : doktorska disertacija

Abstract:Nacionalna regulatorna tijela imaju ključnu ulogu u provedbi regulacije telekomunikacijskog sektora, zbog čega uspjeh u ostvarenju regulatornih ciljeva, u značajnoj mjeri, ovisi o njihovoj kompetentnosti i neovisnosti. Problem, koji se razmatra u ovoj disertaciji, neujednačena je primjena regulacije nacionalnih regulatora na razini država članica Europske unije, uzroci koji dovode do regulatorne nedosljednosti te mogući mehanizmi za njihovo uklanjanje. S obzirom na specifičnost postupka implementacije i provedbe regulacije između europske i razine država članica, razmatrani su odnosi između tijela koja sudjeluju u regulatornom procesu te uloga i učinkovitost djelovanja BEREC-a, kao supranacionalnog foruma za koordinaciju i usuglašavanje regulatorne prakse. Analizom relevantnih odluka Suda Europske unije, razmatrana je njegova uloga "korektora" u ujednačavanju primjene regulacije te odnos sa žalbenim tijelima država članica koja odlučuju u postupcima protiv odluka nacionalnih regulatornih tijela. Posebno je analiziran razvoj regulacije te ustroj i neovisnost regulatornog tijela za telekomunikacije u Republici Hrvatskoj kao "analiza slučaja". Završno, razmatrana su moguća rješenja za unapređenje mehanizama kojima bi se otklonio problem regulatorne nedosljednosti u okviru postojećeg zakonodavstva i u odnosu na eventualne izmjene usmjerene prema uvođenju efikasnijih instrumenata i mehanizama regulacije.

Abstract:National regulatory bodies have a key role in the enforcement of regulation of the telecommunication sector, due to which the success in the realisation of regulatory goals depends significantly upon their adequacy and independence. The issue discussed in this dissertation is the inconsistent implementation of regulation of the national regulators on the level of European Union member states, and the causes which lead to regulatory inconsistency and the possible mechanisms for their elimination. As for the specific nature of the implementation procedure and the enforcement of regulation between European and state member level, the relations between bodies which participate in the regulatory process and the role and efficiency of the activity of BEREC, as supranational forum for coordination and harmonisation of regulatory practice, have been reviewed. The analysis of the relevant decisions of the Court of Justice of the European Union has allowed an overview of its role as ''corrector'' in harmonising the implementation of regulation and its relationship with the appeal bodies of state members which decide in the procedures against decisions of national regulatory bodies. Special emphasis has been placed on the development of regulation, as well as the organisation and independence of the regulatory body for telecommunication in the Republic of Croatia within a case study. In conclusion, this paper examines the possible solutions for the improvement of mechanisms by which the problem of regulatory inconsistency would be eliminated within the framework of the existing legislation and in regard to the eventual changes directed towards introducing more efficient instruments and mechanisms of regulation.
