Abstract:Pomen pacientovih pravic narašča povsod po svetu. Predstavljajo osrednjo zahtevo v procesu zdravstvenega varstva, saj je tudi pacientova vloga v tem procesu vse večja. V diplomski nalogi smo obravnavali dosežen nivo pacientovih pravic ter opisali njihov razvoj pri nas in v svetu. Proces približevanja k enakopravnosti deležnikov v procesu zdravstvenega varstva: pacientom, zdravnikom, fizioterapevtom in ostalimi udeleženci razumemo kot proces izboljševanja pacientovih pravic. Nedvomno je ugotovljeno, da so pacienti vse bolj osveščeni in se vse bolj zavedajo svojih pravic. Upravičeno pa se pričakuje in tudi zahteva njihova odgovornost pri skrbi za svoje zdravje. Pacientovo zaupanje v zdravstveno varstvo je odvisno od nivoja spoštovanja njegovih pravic. Njegovo zaupanje v zdravstveno varstvo bo največje ob doslednem spoštovanju njegovih pravic in ko se bo počutil enakopravnega udeleženca v tem procesu. Stanje pacientovih pravic smo v nalogi prikazali z analizo javno objavljenih podatkov o stanju pacientovih pravic, prikazali njihov trend in opozorili na dejavnike, ki vplivajo na njihov nivo. Uporabili smo letne podatke pristojnega ministrstva za obdobje od 2014 do 2018. Analizirano obdobje je relativno kratko, kar je posledica kratkega obdobja po sprejemu ZPacP. Ugotovili smo, da so pacienti glede svojih pravic iz leta v leto vse bolj osveščeni in se vsako leto v večji meri poslužujejo uzakonjenih postopkov. Kljub povečanju števila obravnavanih primerov kršitev se stanje spoštovanja pacientovih pravic v Sloveniji ne slabša, kot bi morda na prvi pogled kazale številke. Predvidevamo, da lahko to rast pripišemo predvsem večjemu ozaveščanju pacientov o njihovih temeljnih človekovih pravicah in svoboščinah, s tem pa tudi o njihovih konkretnih pacientovih pravicah. Ugotovitve nam služijo za oceno stanja in trend spoštovanja pacientovih pravic v Republiki Sloveniji po sprejetju ustrezne zakonodaje. Menimo, da smo predstavili in dobro spoznali pomen Zakona o pacientovih pravicah. Opisali smo z njim predpisane postopke za uveljavljanje pacientovih pravic in z opravljeno analizo potrdili postavljeno hipotezo, da so se pacientove pravice izboljšale po sprejetju tega zakona.

Title:Patients rights
Abstract:The importance of patients’ rights is increasing all over the world. They represent the central demand in the health care process where the patient’s role in this process is gaining importance too. In the thesis, we have described the achieved level of patients’ rights and described their development at home and worldwide. The process of getting all the participants equal in the health care process: patients, doctors, physiotherapists and other participants is understood as improvement of patients’ rights. It has been found out unambiguously that patients are getting more aware of their rights. It is reasonably expected and demanded their own responsibility for their health. Patients’ trust in the healthcare system depends on the level of their rights respect. It will be the greatest when their rights will be respected consistently and when they will feel as equal participants in the process. The condition of patients’ rights was presented with an analysis of publicly available data, showed their trend and warned on factors, which influence their level. We have used the annual data of the ministry in charge for the period from 2014 to 2018. The analysed period is relatively short, which is due to short time after the law had been passed. We have found out that patients are every year more aware of their rights and that they use the legalised procedures more too. In spite of increased number of cases, there is no decline in the field of patients’ rights respect as could be concluded from the figures. We assume that the increase is probably due to greater awareness of patients on their basic human rights and liberties and consequently on their particular patients’ rights. Findings are used to evaluate the condition and trend of patients’ rights respect after specific legislature in the Republic of Slovenia had been passed. We believe that we have introduced and are well aware of the importance of the Patients’ Rights Law. We have described procedures for assertion of patients’ rights and confirmed the set hypothesis by performing analysis that patients’ rights improved after the law had been passed.
