Title:Primerjava dobrih praks varovanja človekovega dostojanstva v slovenskem in norveškem zapornem sistemu : magistrsko delo

Abstract:Magistrsko delo je nastalo v želji izboljšanja varovanja človekovih pravic in dostojanstva v slovenskih zaporih. Za primerjavo se nam je zaradi dokumentarne serije, ki smo jo gledali na Netflixu, imenovane Inside the world's toughests prisons, zdela najbolj primerna Norveška. Na kanalu YouTube smo pogledali filmčke o nekaterih norveških zaporih, ki so v teh posnetkih predstavljeni kot najbolj humani zapori na svetu. V magistrskem delu so predstavljeni in z norveškim sistemom primerjani ter analizirani postopki, ki jih zaposleni v Oddelku za varnost vsakodnevno izvajamo in ki lahko v veliki meri posegajo v človekovo dostojanstvo in varovanje tega. Ohranjanje človekovega dostojanstva je, še posebej v ustanovi, kot je zapor, izrednega pomena. Zaprte osebe so med prestajanjem zaporne kazni izpostavljene raznim situacijam ter postopkom, ki lahko vsakemu posamezniku posebej pomenijo razvrednotenje njegovega dostojanstva in kršitve njegovih pravic. V vseh zapornih sistemih, tudi v slovenskem in norveškem, so postopki, ki so z vidika varovanja človekovega dostojanstva težavni, a se jim ni moč izogniti ali jih preprečiti, saj so obvezen sestavni del prestajanja zaporne kazni. Pri teh postopkih je težko ohranjati človekovo dostojanstvo, tako na strani zaprte osebe kot na strani zaposlenih. V magistrskem delu smo proučili način izvajanja teh postopkov v enem in drugem sistemu. Ugotovili smo, kateri sistem je človeku bolj prijazen in bolje poskrbi za človekovo dostojanstvo ter kateri primeri dobrih praks so tisti, ki bi jih Slovenija morala prenesti v svoj zaporni sistem tako, da bi zagotovila večje človekovo dostojanstvo tako za zaprte osebe kot tudi za zaposlene v zaporih.

Abstract:The thesis was created in order to improve the protection of human rights and dignity in Slovene prisons. For comparison with Slovene sistem, because of the series we wached on Netflix called Inside the world's toughest prisons, we found the Norwegian system as most appropriate. On YouTube channel, we watched short films about Norwegian prisons that were adverised as the most humane prisons in the world. The thesis presents, compares and analyzes procedures that prison employees carry out on a daily basis and which can have great impact and interfere with protection of human dignity. Maintaining human dignity is, especially in an institution such as a prison, of extreem importance. The inmates are often exposed to situations where their human dignity can be devalued. In every prison system there are procedures that are problematic regarding obtaining human dignity. With research we have done we have realised which of the two systems is more friendy for prisoners and takes better care of human dignity. And also which examples of good practice are those that the Slovene government should implement in its prison system in order to ensure greater human dignity for prisoners as well as for prison staff.
