Title:Etažno vlasništvo u kontekstu zakonodavstva Republike Hrvatske u prošlosti i sadašnjici : magistrsko delo

Abstract:U ovom radu za što bolje razumijevanje etažnog vlasništva definirat će se i pravo vlasništva te suvlasništva. Zakonom o vlasništvu i drugim stvarnim pravima uređeno je uspostavljanje vlasništva posebnog dijela nekretnine, odnosno etažno vlasništvo, koje proizlazi i ostaje neodvojivo povezano s odgovarajućim suvlasničkim dijelom nekretnine na kojem je uspostavljeno, što znači da je vlasnik posebnog dijela nekretnine ujedno i suvlasnik cijele te nekretnine. Vlasnik posebnim dijelom nekretnine izvršava vlasničke ovlasti i dužnosti kao da je taj posebni dio samo njegovo vlasništvo pa i može, ako nije drugačije određeno svakog drugog iz toga isključiti. Etažno vlasništvo ili vlasništvo posebnog dijela nekretnine može bit uspostavljeno na odgovarajućem suvlasničkom dijelu nekretnine koja se sastoji od zemljišta sa zgradom ili od prava građenja. Ono može biti uspostavljeno glede dijela nekretnine koji čini samostalnu cjelinu prikladnu za samostalno izvršavanje ovlasti kao što je stan ili neka druga samostalna prostorija. Cilj ovog rada je što bolje i detaljnije prikazati i pojasniti problematiku složenog pravnog instituta vlasništva posebnog dijela nekretnine, analizirajući koji dijelovi nekretnine mogu biti objekti etažnog vlasništva, zatim pojašnjavajući upis u zemljišne knjige te opisati izvršavanje ovlasti vlasnika.

Title:Condominium ownership in the context of the legislation of the Republic of Croatia in the past and present
Abstract:In this work, for a better understanding of condominium ownership, both ownership and co-ownership will defined. The Law on Ownership and Other Real Rights regulates the establishment of ownership of a separate part of real estate, condominium ownership, which arises and remains inseparably linked to the corresponding co-ownership part of the real estate on which it is established, which means that the owner of a separate part of the real estate is also a co-owner of the whole real estate. The owner of a particular part of the property exercises the ownership powers and duties as if that special part was only his property, so he can, unless otherwise specified, exclude anyone else. Condominium ownership can be established on the appropriate co-ownership part of the property consisting of land with the building or the right of construction. It may be established in respect of a part of a property which makes an independent unit suitable for the exercise of powers such as an apartment or other independent room. The aim of this paper is to better illustrate and clarify the problems of complex legal institute of ownership of a particular part of real estate, analyzing what parts of real estate can be objects of condominium ownership, explaining the entry in the land register and describe the exercise of the owners powers
