Title:Oploditev z biomedicinsko pomočjo po novi ureditvi : spolna asimetrija in prezrt položaj otrok

Abstract:Članek obravnava ustavnopravne in etične dileme slo-venske ureditve postopkov oploditve z biomedicinsko po-močjo po odločbi Ustavnega sodišča RS iz leta 2024, ki je omogočila dostop do oBMP samskim in istospolnim žen-skam. Avtor opozarja, da je bila z odpravo diskriminacije žensk ustvarjena nova oblika neenakosti – izključitev mo-ških iz možnosti biološkega starševstva zaradi absolutne prepovedi nadomestnega materinstva. takšna ureditev po vsebini pomeni spolno diskriminacijo in krnitev pravice do družinskega življenja ter svobodnega odločanja o rojstvu otrok. Poseben poudarek je namenjen tudi pravicam otrok, rojenih s pomočjo oBMP, predvsem pravici do poznava-nja izvora in pravni varnosti glede starševstva. Na podlagi primerjalnopravne analize članek predlaga uvedbo strogoreguliranega altruističnega nadomestnega materinstva kot možne poti do uravnotežene ureditve, ki bi hkrati varovala dostojanstvo žensk, omogočila enakost spolov in zagotovi-la otrokove pravice.

Title:Assisted reproduction after the new regulation: gender asymmetry and the overlooked position of children
Abstract:the article examines the legal and constitutional dilem-mas of artificial insemination regulation in Slovenia follow-ing the 2024 Constitutional Court decision that granted ac-cess to single and same-sex women. the author argues that while the ruling eliminated discrimination against women,it simultaneously created a new form of inequality by ex-cluding men from the possibility of biological parenthood due to the absolute ban on surrogacy. this legal framework amounts to gender discrimination and an infringement of men’s rights to family life and reproductive autonomy. the paper also addresses the rights of children born through assisted reproduction, focusing on their right to know their origins and to legal certainty regarding parenthood. Based on comparative analysis, it proposes the introduction of a strictly regulated altruistic surrogacy model that would pre-serve women’s dignity, ensure gender equality, and safe-guard children’s rights.
