Title:Pomen človekovih pravic in izvrševanje sodb ESČP : diplomsko delo

Abstract:Človekove pravice današnjega časa so izjemnega pomena, saj so temelj civilne in demokratične družbe. Skozi zgodovino so se uveljavile v številnih listinah, dokumentih in ne nazadnje tudi v ustavah. Vzori ustav ZDA, francoske ustave (Deklaracija o pravicah človeka in državljana) so bili vodilo za pisanje ustav v evropskem prostoru. Zaščita ljudi s človekovimi pravicami pred oblastjo in pred arbitrarnimi posegi v življenje ljudi daje ljudem pravno varstvo, ki ga zagotavljajo redna in ustavna sodišča. Po grozotah druge svetovne vojne je bila Evropa na vrhuncu spoznanja, da morajo biti človekove pravice vključene v najvišje pravne akte držav in tako je nastala skupna mednarodna organizacija, z željo in ciljem po preprečitvi takšnih dejanj v prihodnje. Tako kot smo bili ljudje skozi zgodovino priča mnogim kršitvam človekovih pravic, smo tudi danes. Obstoj institucije, kot je Svet Evrope, je izjemnega pomena, saj v okviru nadzora Odbora ministrov Sveta Evrope skrbi za dosledno in učinkovito spoštovanje človekovih pravic v državah podpisnicah ter za ohranjanje načela pravne države, demokracije, pluralizma in enakosti pravic za vse ter vsakršno prepoved diskriminacije. Odbor skrbi za učinkovito izvrševanje in implementacijo sodb Evropskega sodišča za človekove pravice ter od držav terja politično voljo, moralno etiko, da storijo vse potrebno, da je za človekove pravice in izvršitev sodb poskrbljeno. Države imajo torej pozitivno pravno obveznost, da uresničujejo sodbe ESČP in preprečujejo podobne kršitve, izhajajoč iz odločb ESČP v prihodnje ter da se domača sodišča posamezne države članice sklicujejo na sodno prakso ESČP. Vendar ni vedno tako in je od držav potrebno terjati večjo politično voljo, da izvrši posamezno sodbo. To je še posebej pomembno pri težjih primerih, kadar za pritožnike vsakršen predlog trajanja postopka in nedoslednost pušča v njihovem življenju trajne in škodljive posledice. Zagotovitev pravičnega zadoščenja je za pritožnika ključnega pomena, zato si morajo države prizadevati, da bo v prihodnje nerešenih zadev čim manj in da bo storjeno vse, da bodo človekove pravice resnično uresničene v posamičnem pravnem redu držav članic.

Abstract:Human rights are extremely important nowadays, for they are the foundation of the civil and democratic society. Through the history they were established in numerous charts, documents and last, but not the least, also in the constitutions. The examples of the constitutions of the United States of America, French constitution (Declaration on human rights of the person and the citizen) were the guidance for writing the constitutions in the European space. Protection of the people by means of human rights against the power and arbitrary interventions into the life of the people, gives people legal protection, which is ensured by regular and constitutional courts. After the horrors of the World War II, Europe was at the climax of revelation that human rights must be included into the highest legal acts of the countries and so a common international organization was created with a desire and the goal to prevent such actions in the future. We, the people witnessed many violations of human rights in the history and it is the same today. The existence of the institution such as the Council of Europe is extremely important: within the control of the Committee of Ministers of the Council of Europe it takes care of consistent and efficient respect of human rights in the states signatories as well as for the preservation of the principle of the rule of law, democracy, pluralism and the equality of the rights for all and for prohibition of any discrimination. The committee also takes care of the efficient execution and implementation of the rulings of the European Court of Human Rights; it demands from the countries a political will, moral ethics to do all what is necessary to take care of the human rights and the execution of the rulings. Therefore, the countries have a positive legal obligation to implement the rulings of the ECHR and prevent similar violations, proceeding from the decisions of the ECHR in future, and that domestic courts of the individual countries refer to the case-law of the ECHR. However, it is not always so and more intensive political will has to be demanded from the countries to implement individual rulings. This is especially important in more difficult cases when any proposal of duration of the procedure and any inconsistency create durable and damaging consequences in the life of the plaintiffs. Ensuring just satisfaction is essential for the plaintiff. Therefore, the countries must strive for that in the future the amount of pending cases will be the least possible and that everything will be done for the human rights to become truly implemented in individual legal orders of the member states.
