Title:Ustavnopravno varstvo zakonske zveze in družine : magistrsko delo

Abstract:Zakonska zveza in družina sta pomembna instituta, ki ju pravno varuje Ustava Republike Slovenije in Zakon o zakonski zvezi in družinskih razmerjih, visoke standarde pa opredeljuje tudi pravo Evropske unije. Družina je najbolj naravna in osnovna ter hkrati tudi najbolj ranljiva življenjska skupnost, zaradi česar morajo biti ukrepi države glede družinskega življenja ustrezni, da ne presežejo namena, ki mu sledijo. Država mora predpisati in izvajati le smotrne ukrepe, ki so v življenjskih situacijah pričakovani in hkrati opravičljivi. Zakonska zveza, zunajzakonska skupnost in istospolna partnerska skupnost so prav tako izredno občutljive življenjske skupnosti, ki jih med seboj kreirajo odrasli, pogosto pa so vezane tudi na družinsko življenje. Zunajzakonska skupnost postaja vedno pogostejša oblika partnerske skupnosti, saj se partnerji redkeje odločajo za sklenitev zakonske zveze. Zunajzakonska skupnost prinaša pod določenimi pogoji enake pravne posledice za partnerja, nekatere pa so pridržane izrecno za zakonca. Vedno pogostejša oblika je tudi istospolna partnerska skupnost, ki pravno ni izenačena z različnospolno skupnostjo in vzbuja srdite razprave med strokovno in laično javnostjo. Po večletnih poskusih spremembe zakonodaje je bil letos sprejet Zakon o partnerski zvezi, ki se bo začel uporabljati februarja 2017 in za istospolne pare uvaja enake pravne posledice, kot jih ima zakonska zveza, a brez možnosti posvojitev in postopkov biomedicinske oploditve. Pomembno za družino in zakonsko zvezo, zunajzakonsko skupnost in istospolno partnersko skupnost je tudi mednarodno pravno varstvo, ki ima s svojimi obsodbami držav članic veliko moč vpliva na nacionalne zakonodaje. Magistrsko delo nudi celovit pregled slovenske in evropske zakonodaje ter sodne prakse, ki je odsev trenutnih aktualnih družbenih razmer in pokaže morebitne potrebe po spreminjanju predpisov.

Abstract:Marriage and family are important institutes which are legally protected by the Constitution of the Republic of Slovenia and Marriage and Family Relations Act, high standards are also set by the law of the European Union. Family is the most natural and basic as well as the most vulnerable community, for this reason the measures taken by the State related to family life must be suitable in order to not exceed the purpose which they are following. The State must regulate and implement only effective measures which are in family situations expected and at the same time excusable. Marriage, extramarital union and same-sex union are also extremely sensitive living communities which are created among each other by adults and often also related to family life. Extramarital union is becoming a more and more frequent form of partnership union since partners rarely decide for marriage. Extramarital union brings under certain conditions the same legal consequences for the partner while some are held expressly till the end. An increasing form of partnership is also same-sex union which is not legally treated the same as heterosexual union and causes wrathful discussions between expert and secular public. After many years of attempts to change the legislation, this year the Partnership Act was adopted and will come in use in February 2017. It introduces the same legal consequences for same-sex couples as indicated in marriage but without the possibility to adopt and the process of biomedical fertilization. The international law, which has a strong impact on national laws with its condemnations of the Member States, is also important for family and marriage, extramarital union and same-sex union. The thesis offers a complete overview of Slovenian and European legislation, and case law which is the reflection of current social situations and shows possible needs to change regulations.
