Title:Zemljiškoknjižna ureditev vodnih zemljišč : magistrsko delo

Abstract:Za potrebe upravljanja in gospodarjenja z vodami predvideva zakonodaja s področja voda določitev in evidentiranje vodnih zemljišč. Magistrsko delo obravnava te načine evidentiranja vodnih zemljišč in ureditev statusa vodnega javnega dobra v javnih evidencah glede na različne pravne podlage. Podrobneje so predstavljene določbe Zakona o vodah o evidentiranju vodnih zemljišč v javnih nepremičninskih evidencah in pravila, ki se pri tem evidentiranju uporabljajo. Izpostavljena je potreba po tem, da se v tej zvezi vzpostavi dejanska raba prostora. Nazadnje je nakazana tudi posebna problematika togih pravil na področju nepremičnin, ki otežujejo ustrezno umestitev voda v tako zakonodajo. Avtorica te magistrske naloge se v delu osredotoča na dejansko rabo in lastništvo vodnih zemljišč ter posledično na usklajenost uradnih evidenc s stanjem v naravi, ki pa se razlikujeta. Razlog za odstopanja gre iskati predvsem v tem, da se struge vodotokov skozi desetletja premikajo, bodisi po izvedenih regulacijah ali po naravni poti. Tako obstajajo v Republiki Sloveniji vodna zemljišča v naravi in vodna zemljišča po evidenci zemljiškega katastra. V primerih, kjer se izkaže, da so podatki o isti parceli vodnega zemljišča iz obeh podatkovnih virov različni, je treba uskladiti zemljiškoknjižno stanje z dejanskim. Predstavljena so različna problemska področja oz. skupine posameznih primerov neskladij, ki se jih lahko obravnava enako, in postopki ureditve, ki privedejo do urejenega stanja evidenc zemljiškega katastra in zemljiške knjige. Na podlagi analize veljavne zakonodaje je prikazan pravilen način ureditve vodnih zemljišč z lastninskega vidika in postopek vpisa oz. izbrisa statusa vodnega javnega dobra na obravnavanem področju. Z ažurnimi in realnimi evidencami vodnih zemljišč v Republiki Sloveniji, določenimi na podlagi strokovno vodarskih kriterijev in določenih statusih vodnih zemljišč, je omogočeno uveljavljanje pravnega režima vodnih zemljišč in omejevanje lastninske pravice na parcelah v zemljiškem katastru. Kakovostno vzpostavljene in urejene zbirke podatkov o vodnih zemljiščih, ki vsebujejo ažurne podatke, bi pripomogle k boljšemu upravljanju, razpolaganju in načrtovanju z vodami, zagotavljajo pa tudi pravno varnost lastnikom nepremičnin.

Abstract:In order to ensure a proper water management the water legislation outlines the determination and registration of water lands. This master's thesis deals with the registration of water lands and the regulation of the public water assets status in public registers according to different legal bases. It discusses the relevant provisions of Waters Act on recording of water lands in public real-estate registers and rules that are being used in these recording procedures. Accordingly, the need for introduction of the current land usage is emphasized in this context. Lastly, the thesis indicates problems that appear when one tries to bring water-related matters into the rigid real-estate legislation. The author of the thesis focuses on the actual usage and the ownership of the water lands. Furthermore, she delves into the data in official registers that do not correspond to the state of affairs in the nature. These discrepancies can be attributed to the fact that watercourse-beds, as a consequence of man-made adjustments or because of the natural processes, change over the course of decades. Thus, in Slovenia one can find different water lands in nature and water lands according to the records in the land cadastre. When the data on the same plot are different in the two data sources, it is necessary to align the status in the registers with the actual status in nature. The author presents different examples of disparities that occur and the procedures that lead to an orderly regulated status of land cadastre and land register. On the basis of the applicable legislation analysis, the thesis demonstrates the correct method of water land regulation from the perspective of the ownership issue. Furthermore, the procedure of the entry in the register and deletion from the register of the public water assets in the field under consideration is presented. Updated and real records of water lands in the Republic of Slovenia, determined by professional water management standards and established statuses of water lands, enable the implementation of the legal regime on water lands and limitations of property rights. Orderly arranged registers on water lands that contain updated data would not only contribute to better water management and planning but they would also ensure legal certainty to the real-estate owners.
