Title:Državni in zasebni vidik implementacije čezmejnega zdravstvenega varstva v Evropski uniji : magistrsko delo

Abstract:Zdravje je v sodobnem svetu ena najpomembnejših javnih in zasebnih dobrin, ki ga želimo ohraniti in delovati tudi na njegovo izboljšanje. Dinamične spremembe v družbi, napredek znanosti, staranje prebivalstva, uvajanje novih metod zdravljenja in novih tehnologij, razvoj znanj na številnih področjih ter mnogi drugi dejavniki, ki po naši oceni, vplivajo na spremembe v družbi, zahtevajo tudi ustrezno prilagajanje pravnih norm in uvajanje novih pravnih norm, ki morajo slediti novim potrebam družbe in posameznikov. V magistrskem delu smo raziskovali državnopravni in zasebnopravni vidik implementacije Direktive 2011/24/EU Evropskega parlamenta in Sveta o uveljavljanju pacientovih pravic pri čezmejnem zdravstvenem varstvu, ki jo je sprejel Evropski parlament 9. marca 2011. Slovenija je kot polnopravna članica EU implementirala direktivo v svoj pravni red. Ukvarjali smo se z razčlembo pomena in vpliva implementacije z državnega in zasebnega vidika ter vidika dejanske uporabe v praksi. Direktiva predvideva možnost obravnave pacientov pri ambulantnih storitvah v tujini, državah članicah EU, brez predhodnega soglasja nacionalnega zdravstvenega sistema. Predstavili smo probleme, ki so povezani z zagotavljanjem zdravstvenih storitev, kot so: čakalne dobe, enaka dostopnost za vse državljane, enake kakovosti zdravstvenih storitev znotraj držav članic EU, konkurenčnost, stroški financiranja zdravstvenih storitev; različnost zdravstvenih sistemov med državami članicami; zagotavljanje enake kakovosti zdravstvenega osebja; zagotavljanje uporabe najnovejših metod zdravljenja; opremljenost in organiziranost zdravstvenih ustanov ter druge probleme, ki lahko vplivajo na učinkovitost in uporabnost pravnih rešitev, ki jih direktiva prinaša. S pomočjo anketnega vprašalnika, v katerem je sodelovalo 787 oseb smo raziskali posameznikov pogled na področju čezmejnih zdravstvenih storitev in njegovo poznavanje pravic, ki izhajajo iz sprejete direktive o zagotavljanju čezmejnih zdravstvenih storitev. Podali smo tudi nekaj rešitev in izboljšav, ki bi lahko prispevali k izboljšanju slovenskega zdravstvenega sistema v povezavi z implementirano direktivo.

Abstract:In contemporary society health is one of the most important public and private valuable assets. Dynamic changes in the society, including scientific development, aging of the population, introduction of new treatment methods, constantly developing technology, scientific advancements in several areas of life and several other factors require adequate adaptation of legal norms and application of new ones, which should comply with the changing needs of the society and individuals. The master thesis explored into the state and private law aspects of the implementation of the Directive 2011/24/EU of the European parliament and of the Council of 9 March 2011 on the application of patientsʼ rights in cross-border healthcare. Slovenia, as an equal member state of the European Union, implemented the transposition of this Directive into national legislation. The thesis discusses and analyses the issues pertaining to the implementation of the state and private law aspects of the Directive and its application. According to this Directive, patients have access to safe and high-quality cross-border ˝non-hospital˝ services, for which pre-authorization is not considered necessary. The thesis presents an analysis of the broader context related to cross-border healthcare in the European Union, the legal uncertainties surrounding cross-border healthcare and the problems associated with the provision of healthcare services, such as: waiting lists, equal health care accessibility to patients from all member states, cost competitiveness, the reimbursement of costs of cross-border healthcare, the diversity of health systems in EU member states, guarantee of quality and safety standards of services and personnel, the provision of state-of-art treatment methods, the furnishings and organisation of healthcare facilities and other issues that impact the efficiency and applicability of legal solutions detailed in this Directive. The data were collected through a structured survey questionnaire completed by 787 study participants. The analysis of the data obtained reveals the participantsʼ views on cross-border health care and the awareness of their rights in cross-border health care as defined in the adopted Directive. We offered some suggestions and proposed some solutions which may contribute to the improvement of the Slovenian healthcare system in association with the implementation of the directive on cross-border health care.
