Title:Etične dileme podjetnika - menedžerja pri zaposlovanju in odpuščanju delavcev : magistrsko delo

Abstract:Veliko se govori o pomenu in nujnosti uveljavljanja etike na vseh področjih, vendar se pri tem pogosto pozablja, da je ravno človek temelj etike in da je etika bistvo človekovega delovanja, ki ga usmerja v iskanje dobrega in mu pomaga ustvarjati bolj prijazen svet, v katerem lahko človek so-deluje. Eno najbolj izpostavljenih področij za (ne)etično ravnanje v podjetju je tako prav področje zaposlovanja in odpuščanja delavcev. V magistrskem delu opredeljujemo odnos človeka do etike in etike do človeka. Predstavljamo opredelitev etike, namen in cilj etike, vlogo etičnih teorij ter odnos moralnih vrednot in temeljnih kreposti do etičnih norm. Poslovno etiko razumemo kot posebno področje etike, ki nam daje smernice za vedénje, obnašanje in ravnanje ter ukrepanje pri poslovanju. Pomemben je prispevek Cerkve in cerkvenega nauka pri reševanju odnosa delodajalci-delavci, saj je vplival na začetke zakonskega urejanja delavskih pravic. Etika v podjetju zastavlja številne etične dileme, ki izvirajo iz težnje po učinkovitem podjetju, zato pa prihaja do izkoriščanja delavcev. Obravnavamo ravni in vire poslovne etike, opredeljujemo razmerje med poslovno etiko in zakoni. Posebej opozorimo na negativne poslovne prakse kot posledico tranzicijskega prehoda iz totalitarističnega v demokratični sistem. Ob tem je ključna vloga in delovanje menedžerja, ki se mora zavedati pomena vrednot in sploh etike v delovanju podjetja. Kršitve etičnih standardov pomenijo menedžerjevo neetično delovanje. Ker so za vodenje podjetja odgovorni menedžerji, je od njihovega ravnanja v največji meri odvisno, v kolikšni meri se etične vrednote v podjetju spoštujejo. Zato so ključna vodila, ki so menedžerju v pomoč ob etičnih odločitvah. Zgolj dobičkarsko gledanje na področje zaposlovanja in odpuščanja delavcev je praviloma razlog za neetično ravnanje pri zaposlovanju ali odpuščanju delavcev. Zato ima pomembno vlogo pravna ureditev oziroma zakonodaja, ki ureja področje zaposlovanja in dela v Sloveniji in drugod. Ureditev sklepanja, prenehanja ali odpovedi pogodbe o zaposlitvi v aktualni zakonodaji o delovnih razmerjih ne sme biti samo zakon, pač pa tudi etični standard, ki mora imeti svoj temelj v etičnosti sklepanja pogodbe o zaposlitvi tudi za določen čas. Rezultati opravljene telefonske ankete nam potrjujejo, da je za večino menedžerjev oziroma lastnikov podjetij etično ravnanje pomembno, vendar vedno ko gre za vprašanje koristi podjetja, interese lastnikov ali lastne interese, pa na etiko pogosto preprosto pozabijo. Podobno velja tudi za področje zaposlovanja ali odpuščanja delavcev.

Abstract:A lot is being said about the importance and implementation of ethics in all areas, but it is often forgotten that the man is the basis of ethics and that it is the ethics that is the essence of human function, one that steers him in search of good and helps him establish a more kind world in which a man can cooperates. One of the most exposed areas of (un)-ethical conduct in the company is the area of employment and dismissal of workers. In this master thesis we define the relationship between a man and ethics. We introduce the definition of ethics, purposes and goals of ethics, the role of ethical theories and the relationship of moral values and basic virtues. We understand business ethics as a special area of ethics, one that gives us guidelines in behavior, conduct and course of action in business. Church and its doctrine were an important contribution in resolving the employer-empoyee relationship by influencing the nitiation of regulation of labor rights. Ethics in a company raises many ethical dilemmas that originate from the tendencies for a more effective company and therefore causes the worker exploitation. We are considering the levels and sources of business ethics, we are defining the relationship between business ethics and law. We put special emphasis on the negative business practices as a result of a transition from totalitarian to democratic system. In all this the key role is that of the manager, who must be aware of the meaning of values and ethics in working of a company. Violations of ethical standards mean the managers unethical conduct. Since the managers are responsible for running the company, their conduct determines how much will the ethical values be respected within the company. Therefore the instructions are vital in helping the manager make a decision in case of ethical dilemmas. Profit-only vision in the area of employment and dismissal is usually the reason for unethical conduct in that area. It is therefore that the employment legislation in Slovenia and other countries plays a big role. Regulating the conclusion, termination or cancellation of the contract of employment in the present employment legislation must not only be an legislative act but also an ethical standard, one that must have its foundations in ethical conclusion of contract of employment even for a fixed period. The results of the telephone survey show us that the majority of the managers or business owners consider ethical behavior important, but when it comes to the issues of business benefit, the interest of the owners or their personal interest they chose to forget about ethics. Same goes for the area of employment or dismissal of workers.
