Title:Naloge zdravstvenega inšpektorata Republike Slovenije po Zakonu o pacientovih pravicah : magistrsko delo

Abstract:Zdravje je pravica vsakega človeka ter ena najbolj cenjenih in želenih vrednot posameznika in družbe. Zdravje posamezniku omogoča kvalitetno življenje, družbi pa socialni in gospodarski razvoj. Pravico do najvišjega dosegljivega standarda fizičnega in mentalnega zdravja varujejo številni pravno zavezujoči mednarodni dokumenti. Tudi Ustava Republike Slovenije s pravico do zdravstvenega varstva uresničuje splošno priznane človekove pravice in temeljne svoboščine, kot so osebno dostojanstvo, telesna in duševna celovitosti ter spoštovanje pacienta kot osebe. Pacient v okviru zdravstvenega sistema vedno predstavlja šibkejšo stran in posledično potrebuje posebno pravno varstvo. Zakon o pacientovih pravicah ureja dvanajstih pravic, ki jih ima vsak uporabnik zdravstvenih storitev. Hkrati z ureditvijo pravic in obveznosti vseh udeležencev v sistemu zdravstvenega varstva zakon ureja način razreševanja nesporazumov in sporov med njimi. Nadzor nad spoštovanjem tega zakona izvaja Ministrstvo za zdravje, pristojnosti Zdravstvenega inšpektorata Republike Slovenije pa so omejene izključno na pristojnosti prekrškovnega organa. V magistrskem delu smo analizirani stanje na področju pacientovih pravic z vidika ugotovitev zdravstvenih inšpektorjev. Le-ti na terenu pogosto ugotavljajo raznovrstne kršitve zakona in neskladja s podzakonskimi akti. Ukrepanje zdravstvenih inšpektorjev je omejeno zgolj na prekrškovno ukrepanje, torej na izrekanje opozoril in glob kršiteljem. Nabor definiranih prekrškov je v zakonu majhen, znotraj tega nabora pa ni veliko prekrškov, katerih znake in odgovornost zanje lahko zdravstveni inšpektorji ugotavljajo sami neposredno pri izvajalcih zdravstvenih storitev. Z raziskavo smo potrdili, da je šibka točka zakona omejen nadzor nad njegovim izvajanjem. Utemeljili smo potrebo po noveli zakona, in sicer s podelitvijo pooblastila Zdravstvenemu inšpektoratu Republike Slovenije za izvajanje nalog inšpekcijskega nadzora in z razširitvijo nabora ukrepov, ki bi jih zdravstveni inšpektorji pri opravljanju inšpekcijskih in prekrškovnih nalog smeli in morali uporabiti, kadar bi ugotovili, da je zakon kršen.

Abstract:Health is the fundamental right of every human being, and one of the most appreciated and desired values of individuals and the society. Health enables quality of life of individuals, and social and economic development of the society. The human right to the highest attainable standard of physical and mental health is protected in different legally binding international documents. The Constitution of the Republic of Slovenia includes the right to health care and thereby exercises the generally recognized human rights and fundamental freedoms such as personal dignity, physical and mental integrity and respect for patient. In the health system, the patient always represents the weaker side and therefore requires a special legal protection. The Act on Patient Rights regulates twelve rights of every user of health care services. The Act specifies the rights and obligations of all the participants in the health care system, and regulates the means of settlement of disagreements and disputes between them. The Ministry of Health conducts the supervision of the observation of this Act, whereas the competence of the Health Inspectorate of the Republic of Slovenia is exclusively restricted to being a minor offence authority. In this master%s thesis we analysed the current situation in the field of the patient rights from the standpoint of the findings of the health inspectors. In practice, they often establish various breaches of the statutory and implementing acts. Being minor offence authorities, health inspectors may only impose a warning or a fine to the offender. The list of defined offences is limited in the Act, and so is a direct supervision of health care service providers exercised by health inspectors regarding the signs of breaking the law and responsibilities of such actions. Our research has confirmed that the limited supervision of the implementation of the regulations of the Act on Patient Rights is weakness of this Act. We have justified the need for law amendment regarding the authorisation to the Health Inspectorate of the Republic of Slovenia for conducting tasks of inspection supervision, and the expansion of the list of measures that health inspectors should and would have to introduce when carrying out their inspection duties and thereby revealing possible irregularities.
