Title:Odvzem prostosti in omejitev gibanja v policijskih postopkih : doktorska disertacija

Abstract:V disertaciji smo raziskovali policijska pooblastila, s katerimi policisti osebam v policijskem postopku posežejo v osebno svobodo in svobodo gibanja in njihovo normativno urejenost skozi prizmo spoštovanja človekovih pravic in temeljnih svoboščin. Proučevanje primarnega in sekundarnega posega v osebno svobodo in svobodo gibanja nas je zanimalo tako s teoretičnega kot praktičnega vidika. Odvzem prostosti ni zgolj administrativna kategorija v predkazenskem postopku ali postopku o prekršku, ampak je najstrožji poseg v osebno svobodo posameznika, ki ga policija sme izvršiti samo takrat, ko je to neizogibno potrebno (ultima ratio), da prime in pridrži osumljenca kaznivega dejanja ter v določenih primerih storilca hujšega prekrška. Odločitev o odvzemu prostosti je v obeh primerih sestavni del postopka, v katerem je policija predhodno zbrala dovolj razlogov za sum, da je oseba storila kaznivo dejanje ali prekršek in mu omeji svobodo gibanja zato, da lahko dokonča zbiranje potrebnih obvestil in dokazov ter ga izroči sodišču. Pri omejitvi svobode gibanja gre za trenutek, ko se soočita osumljeni posameznik in državni aparat prisile. Da država ne bi zlorabila svoje premoči, mora za to poskrbeti pravo. Odvzem prostosti je globok poseg v zasebnost prizadete osebe. Država ga zaradi tega ne sme izvajati brez utemeljenih razlogov. Namen raziskave v disertaciji je proučitev omejitev osebnostnih pravic, konkretno omejitev osebne svobode in svobode gibanja v policijskih postopkih, zavarovanih tako z Ustavo Republike Slovenije kot z mednarodnimi dokumenti.

Abstract:In my dissertation I have researched police authority which is used in the police procedure, and so, police officers interfere with people's personal freedom and freedom of movement, as well as their normative settlement through prism of respect of human rights and basic human freedoms. Exploration of primary and secondary intervention into personal freedom and freedom of movement has been seen upon both, theoretical and practical view. Deprivation of freedom is not only administrative category in the pre-penal procedure or offence procedure, but it is the strictest intervention into personal freedom of an individual, which can be executed by the police only in the inevitably necessary case (lat.: ultima ratio) in order to arrest and detain a suspect of a criminal act and in some cases even an offender of a worse offence. Decision on deprivation of freedom is in both cases a constituent part of procedure, in which the police have in advance gathered enough causes for suspected criminal act or offence, and so the police restrict somebody's freedom in order to finish gathering notice and evidence as well as handing him over to the court of law. Deprivation of freedom is actually a moment when a suspect and a state apparatus of constraint confront each other. The law is the state's tool for not abusing its supremacy. Deprivation of freedom is a deep intervention into privacy of an individual under consideration. Therefore, the state cannot executes it without a just cause. The principle of legal state stipulates the state to have an acceptable constitutional cause, accredited officially by court, for any intervention. The purpose of research in the dissertation is the investigation of personal rights restrictions, specific restriction of personal freedom and freedom of movement in the police procedures which are protected either by The Constitution of Republic of Slovenia or international documents.
