Title:Podobnosti in razlike pravnega položaja "uradnikov" in "strokovno-tehničnih javnih uslužbencev" v slovenskem uslužbenskem pravu : magistrsko delo

Abstract:Podobnosti in razlike pravnega položaja %uradnikov% in %strokovno-tehničnih javnih uslužbence% v slovenskem uslužbenskem pravu najdemo opredeljene v različnih pravnih aktih. Zato bomo v magistrskem delu s pomočjo pravnih aktov, kolektivnih pogodb, vladnih uredb, splošnih aktov drugih državnih organov in pravilnikov ministrstev predstavili, kje nastajajo razlike in podobnosti med %uradniki% in %strokovno-tehničnimi javnimi uslužbenci%. Katere prednosti in ugodnosti imajo določeni uslužbenci, medtem ko so drugi uslužbenci zanje prikrajšani. Ker je znano, da lahko samo od zadovoljnih in dovolj motiviranih javnih uslužbencev pričakujemo odlične rezultate, bomo ugotavljali, na katerih področjih pravnega položaja %uradnikov% in %strokovno-tehničnih javnih uslužbencev% v slovenskem uslužbenskem pravu bi bilo smiselno, da bi vlada spremenila oziroma predlagala spremembe veljavnih pravnih aktov. To pa predvsem s ciljem, da bi te razlike omilili ali celo odpravili, in s tem omogočili večje zadovoljstvo med javnimi uslužbenci, brez večjih finančnih posledic. S tem bi dosegli, da bi lahko že strokovno usposobljeni %strokovno-tehnični javni uslužbenci% kandidirali za zaposlovanje na %uradniških% delovnih mestih. Prav tako se bomo zavzemali za ustreznejše in pravičnejše ocenjevanje javnih uslužbencev in tudi za uvedbo drugačnega, pravičnejšega načina napredovanja obeh kategorij javnih uslužbencev.

Abstract:Similarities and differences of the legal situation of %officials% and %professional-technical public officials% in the Slovenian civil servant legislation are defined in different legal acts. Therefore we are going to present in this master's thesis where differences and similarities between %officials% and %professional-technical public officials% originate by means of legal acts, collective agreements, government decrees, general legal acts of other public authorities and regulations of government departments, which advantages and benefits do certain servants have while other servants are deprived of them. As it is known that excellent results can be expected from satisfied and motivated public officials only we will assess which sections of the legal situation of %officials% and %professional-technical public officials% in the Slovenian civil servant legislation would need a change of current acts. The aim of this, above all, would be to moderate or even to abolish those differences and to enable a greater satisfaction among public officials without bigger financial consequences. By doing so it would be achieved that professionally trained staff could also apply for %official's% positions of employment. We will also strive for a more appropriate and equitable assessment of public officials as well as for the introduction of a different, more equitable method of promotion for both categories of public officials.
