Title:Skupinsko uveljavljanje odškodninskih zahtevkov kot instrument varovanja potrošnikovih pravic : magistrsko delo

Abstract:Slovenska zakonodaja ne pozna primernega instituta, ki bi zagotavljal sodno varstvo večji skupini oseb, ki jih je oškodoval isti subjekt, škoda vsakega posameznika pa ni dovolj velika, da bi krila stroške pravdanja. Kljub materialnim predpisom, ki imajo namen ščititi posamezne oškodovance in ki omogočajo pridobitev odškodnine za nezakonito ravnanje, posamezniki svojih pravic ne uveljavljajo zaradi nesorazmerno velikih finančnih bremen pri uveljavljanju svojih pravic, kar posameznika postavlja v neenakovreden položaj na trgu proti velikim gospodarskim sistemom. Ker na določenih področjih množično prihaja do kršitev, oškodovanci pa se zaradi procesnih ovir ne odločajo za uveljavljanje odškodninskih zahtevkov, ima odgovorni subjekt po eni strani velike koristi, hkrati pa nima potrebe, da bi izboljšal svoj produkt ali storitve. Tako se nezakonito ravnanje nadaljuje in povzroča škodo tako državljanom kot podjetjem. Zato bi posamezniki morali imeti možnost uresničevanja pravice do sodnega varstva tudi v praksi, kadar zaradi kršitve katerega koli nacionalnega predpisa ali predpisa EU, ki jim daje materialne pravice, utrpijo škodo. Združitev tožb v eno samo kolektivno pravno sredstvo (skupinsko tožbo) bi poenostavila postopek in zmanjšala stroške. Na ta način bi posamezniki lahko pridobili odškodnino za škodo, ki jim je bila storjena, možnost plačila odškodnine večjemu številu oškodovancev pa bi v primeru izgube zaslužka podjetja odvračala od nezakonitih dejavnosti.

Abstract:Slovenian legislation recognizes no suitable institute for judicial protectionof a larger group of people wronged by the same subject in cases, where the damage incurred to an individual is not substantial enough to cover the litigation costs. Despite substantive regulations, whose purpose is to protect an individual injured party and enable them to obtain compensation forunlawful conduct, these individuals usually do not exercise their rights due to the disproportionately high financial burden connected to the enforcement of such rights, which puts the individual in a disadvantageous position in relation to large economic systems. There are certain areas where violations are numerous, due to procedural obstacles, however, the injured parties choose not to enforce compensation claims; thus the subject responsible benefits greatly from these circumstances while having no need to improve their product or service. Consequently, unlawful conduct persists and causes damage to both citizens and companies. Individuals should be given a chance to exercise their right to judicial protection in practice as well, when suffering damages due to violations of national or EU regulations, acknowledging their substantive rights. The joining of lawsuits into one collective legal remedy (collective redress or class action lawsuit) would simplify the procedure and decrease the costs. Thus the individuals would get compensation for the damage incurred, while the payment of compensation to a larger number of injured parties and the consequent loss of profit would discourage companies from future unlawful conduct.
