Title:Otroci kot storilci kaznivih dejanj : magistrska naloga

Abstract:V magistrski nalogi sem se osredotočil na obravnavo otrok storilcev kaznivih dejanj, ki je za vse vpletene strokovne službe izredno zahtevna. Predstavil sem delo različnih strokovnih služb (policija, centri za socialno delo, šole, varuh človekovih pravic) in drugih, ki se pri svojem delu kakorkoli srečujejo s to vrstno problematiko (različne nevladne organizacije). Namen raziskave je bilo ugotoviti ali država omogoča strokovnih službam, da lahko svoje delo opravljajo dobro (z sprejeto zakonodajo, različna usposabljanja) in na kakšen način je poskrbljeno za otroke, ki se znajdejo v taki situaciji. Pri svojem delu sem opravil primerjavo z sosednjo državo - Hrvaško. V teoretičnem delu so opisani splošni pojmi in mednarodni dokumenti, ki urejajo status otroka. Opisana je krovna zakonodaja na področju obravnave otrok kot storilcev kaznivih dejanj. Prav tako je v nadaljevanju opisana primerjava med zakonodajo v Sloveniji in na Hrvaškem. Podrobneje je opravljena analiza različnih organizacij, ki imajo stik z otrokom in mu nudijo ustrezno pomoč. V empiričnem delu je opisano stanje kriminalitete na območju Republike Slovenije in Republike Hrvaške. Prišel sem do zaključka, da je kriminaliteta na splošno v upadu in, da je strokovna usposobljenost vpletenih oseb na dobrem nivoju. V veljavi so zakoni, ki omogočajo dobro delo z otroki, ki storijo kaznivo dejanje in jim nudijo dobre rešitve in ustrezno pomoč. Kot pomanjkljivost lahko izpostavim različno delovanje centrov za socialno delo, saj jim manjka centralno-enotno usmerjenje. Moje ugotovitve lahko s pridom uporabijo vse strokovne službe, ki so bile zajete v raziskavi magistrske naloge.

Abstract:In my dissertation I focused on treatment of children as criminal offenders, which is very demanding for all professional services involved. I presented the work of different professional services (police, Centre for social work, school, ombudsman) and others, that come up against these sorts of problems (different non-governmental organizations). The purpose of the research was to reach findings whether the state enables professional services to do a good job (current legislation, different trainings) and how is it provided for children under these circumstances. I compared our legislation with Croatian. In theoretical part of disertation general concepts and international documents regulating child status are described. Umbrella legislation treating children as criminal offenders is disscused. After that a comparison between Slovenian and Croatian legislation is described. Analysis of different organisations treating and helping the child is particularly discussed. In empirical part there is a description of crime conditions in Slovenia and Croatia. I came to the conclusion, that crime rate decreases and that professionals involved are well qualified. Current legislation enables to work well with children commiting a criminal act and it offers them good assistance and adequate help. As a downside I can mention uncoordinated activity of centres for social work since the lack of central direction. These findings are beneficial for all professional services mentioned in this disertation.
