Title:Redna odpoved pogodbe o zaposlitvi : diplomsko delo

Abstract:Diplomsko delo predstavlja institut redne odpovedi pogodbe o zaposlitvi s kratko primerjavo med redno odpovedjo pogodbe o zaposlitvi delavcem in javnim uslužbencem. Redna odpoved je seveda le eden izmed načinov, na podlagi katerega lahko pogodbeni stranki prekineta pogodbo o zaposlitvi in s tem preneha tudi delovno razmerje. Poglavitna vira delovnega prava v Sloveniji, ki urejata prenehanje pogodbe o zaposlitvi, sta ZDR-1 in ZJU. Odpoved pogodbe o zaposlitvi predstavlja zelo pomembno tematiko delovne zakonodaje, saj ima velik vpliv na kakovost življenja delavca, poleg tega pa s seboj prinaša določene pravice. Gre za enostransko izjavo ene pogodbene stranke, posledica katere je prenehanje delovnega razmerja. Postopek odpovedi pogodbe o zaposlitvi je v ZDR-1 jasno definiran in manj formalen, kot je bilo določeno v ZDR. Tako kot Zakon o delovnih razmerjih (ZDR) tudi novi ZDR-1 v posebnem poglavju celovito ureja pogodbo o zaposlitvi, od sklenitve do prenehanja. Največ poudarka sem namenila spremembam, ki jih je na področju odpovedi pogodbe o zaposlitvi, v primerjavi z ZDR, uvedel ZDR-1.Ureditev, ki jo predpisuje ZDR-1, naj bi veljala za vsa delovna razmerja med delavcem in delodajalcem, ne glede na vrsto delodajalca ali naravo zaposlitve. Posebnost pa je za zaposlene v državnih organih in samoupravnih lokalnih skupnostih, ko pride do redne odpovedi pogodbe iz poslovnega razloga, saj to področje ureja Zakon o javnih uslužbencih (ZJU). ZJU izrecno določa, da se glede razlogov za to odpoved pogodbe ne uporabljajo določbe ZDR-1, temveč ZJU.Z odpovedjo pogodbe o zaposlitvi, pogodba o zaposlitvi preneha veljati v celoti. To pomeni, da ni mogoče odpovedati le posameznih določb pogodbe o zaposlitvi oziroma enostransko spreminjati bistvenih sestavin pogodbe. ZDR-1 namreč ne dopušča delne odpovedi pogodbe o zaposlitvi.

Abstract:This thesis represents the institute of the regular termination of a contract of employment with a brief comparison between the regular termination of the employment contract for workers and civil servants. A regular termination is, of course, only one of the ways in which a contracting party can terminate the employment contract and thus terminate the employment relationship. The main source of labour law in Slovenia, governing the termination of the employment contract, are the Labour Relations Act (Zakon o delovnih razmerjih, ZDR-1) and the Civil Servants Act (Zakon o javnih uslužbencih, ZJU). The termination of a contract of employment represents a very important topic of labour law, since it has a significant impact on the quality of life of the workerand it brings certain rights. This is a one-sided statement from one party, the result of which is the termination of an employment relationship. The procedure of termination of the employment contract is clearly defined and less formal in ZDR-1, as defined in the ZDR. Like the Employment Relationships Act (ZDR), the new ZDR-1 regulates in a separate chapter the employment contract, from its conclusion to the termination. I devoted most of my attention to the changes introduced by the ZDR-1 in the field ofthe termination of the employment contract, compared to the ZDR.The arrangement prescribed by ZDR-1 should apply to all labour relations between the worker and the employer, irrespective of the type of employer or the nature of the employment. A specialfeature is for employees in state bodies and self-governing local communities when a regular termination of a contract for a business reason occurs, since this field is governed by the Civil Servants Act (ZJU). ZJU explicitly states that for such a termination of acontract ZDR-1 and not ZJU provisions are to be applied. By terminating the employment contract, the employment contract ceases to be valid in full. This means that it is not possible to cancel only individual provisions of the employment contract or unilaterally amend the essential elements of the contract. ZDR-1 does not allow partial cancellation of the employment contract.
