Title:Odgovornost Evropske unije za stanje pravne in demokratične države v državah članicah : magistrsko delo

Abstract:Osnova za to delo, ki povezuje tri koncepte: demokracijo, vladavino prava in Evropsko unijo, je nastajala med našim celotnim študijem. Ti trije koncepti so nekoliko nejasni, saj nobenega izmed njih ne moremo jasno definirati, kaj točno je, vemo pa,kaj ni, in lahko potrdimo, da vsi trije obstajajo. To je glavni razlog za sestavo tega magistrskega dela, katerega celotno vsebino lahko strnemo v eno vprašanje: Kaj lahko Evropska unija naredi za razvoj demokratične in pravne države? Zanimanje za to tematiko izhaja iz težav,s katerimi se trenutno srečuje Evropska unija, kot so nepopolna Unija, grožnje in izstopi držav članic iz Unije ter drugi podobni dogodki, ki pretresajo sodobno Evropo. Magistrsko delo je plod temeljite analize ukrepov in mehanizmov, ki jih ima Evropska Unija na voljo za vzpostavitev demokracije in vladavine prava v državah članicah. V deluje najprej opravljena študija primerov treh držav članic, Poljske, Madžarske in Slovenije. Omenjene države so bile izbrane, ker sta bili v medijskem prostoru Poljska in Madžarska označeni za avtokratski. Slovenija je bila dodana iz osebnih vzgibov.Na primeru omenjenih držav članic smo naprej preverili,ali so demokratične in pravne, in nato še učinkovitost mehanizmov za varovanje demokracije in vladavine prava, ki so predstavljeni v nadaljevanju dela. Opravljena je tudi primerjava treh analiziranih članic z ostalimi državami EU, in sicer ali se tudi v kateri izmed drugih držav članic kažejo težave z obstojem demokracije in vladavine prava. Ta del magistrskega dela lahko služi tudi kot zelo dobra osnova za nadaljnje raziskovanje področja. Delo se zaključi z analizo in primerjavo ukrepov ter mehanizmov za varovanje demokracije in vladavine prava. Rezultati analize so uporabni predvsem za nadaljnje razvijanje ustreznih ukrepov in prikaz smeri integracije EU v prihodnosti.

Abstract:Basis for this work was formed throughout my entire time of studies. It connects three concepts: Democracy, Rule of Law and European Union. These three concepts are wrapped in mist, since we can`t clearly define what they are, yet we know what they are not. And we can confirm that they exist. That is the main reason for this Master`s degree and its entire content can be summarized in one question - What can European Union do for development of democratic state and rule of law? Interest for this subject derives from the contemporary problems in EU, like incomplete union, threats of member states exiting EU and other similar events that shake modern Europe. Master`s degree is result of thorough analysis of measures and mechanisms at disposal to EU, for establishing democracy and rule of law in member states. In this work, the case study of three countries, Poland, Hungary and Slovenia was conducted first. The following states were chosen, because Poland and Hungray were marked in media as autocratic and Slovenia was added because of personal impulses. We checked first if these member states are democratic and abide by rule of law and with their help, we checked afterwards the efficiency of mechanism presented in this work. A comparison of three analysed members with other member states was also conducted, for the purpose of checking if there are problems with democracy and Rule of Law in other member states. This part of work, can serve as good basis for further research in the field. We conclude the work with analysis and comparison of measures and mechanisms. Analysis results can be used for further development of apropriate measures and demonstrating the bearing of future EU integration process.
