Title:Pristojnost odločanja v upravnem sporu : diplomsko delo

Abstract:Upravni spor je urejen v 157. členu Ustave Republike Slovenije in predstavlja obliko sodnega nadzora nad zakonitostjo dokončnih posamičnih upravnih aktov, izdanih v upravnih postopkih s strani oblastnih organov v zadevah javnopravne narave. Poleg nadzora zakonitosti dokončnih upravnih aktov predstavlja upravni spor tudi sodni nadzor nad dejanji in posamičnimi akti, ki posegajo v ustavno zagotovljene pravice posameznika, s pogojem, da ni zagotovljeno drugo sodno varstvo - to posebno vrsto upravnega spora imenujemo tudi kvazi upravni spor. Da bi torej zagotovili zakonitost delovanja v upravnem postopku, Ustava Republike Slovenije predvideva zunanji nadzor, ki ga opravlja sodna veja oblasti oziroma neodvisni sodniki, ki so pri svojem delu vezani le na zakone in ustavo, v upravnem sporu odločata Upravno sodišče Republike Slovenije ali Vrhovno sodišče Republike Slovenije. Praviloma na prvi stopnji odloča Upravno sodišče Republike Slovenije, izjemoma, kadar zakon tako določa, Vrhovno sodišče Republike Slovenije, ki praviloma odloča v postopku s pravnimi sredstvi v upravnem sporu.

Abstract:Administrative dispute is regulated in 157th Article in Constitution of the Republic of Slovenia and it represents a form of judicial control to protect a principle of legality of finally-binding administrative acts, issued in administrative procedure by agencies deciding in public law matters. Furthermore, administrative dispute is a form of judicial review of actions and individual acts, which interfere in constitutionally assured human rights - this special form of administrative dispute is called quasiadministrative dispute. Judicial review is assured even though that clients in administrative procedure can go through stages of appeal, in which agencies decide about the matter, moreover they issue administrative acts according the directions of their higher agencies and this can break the principle of legality in administrative procedure. To assure this principle in administrative procedure, Constitution of Republic of Slovenia foresees external review, performed by judicial branch and its independent judges, which are bound only to Constitution and laws, when judging. Judicial review of administrative acts in Republic of Slovenia is performed by Administrative court of Republic of Slovenia and Supreme court of Republic of Slovenia. In most cases, the court of first instance is Administrative court while the second instance is reserved for Supreme court, which also decides on possible legal measures.
