Title:Zakonodajne spremembe na področju kolektivnega upravljanja v avtorskem pravu : diplomsko delo

Abstract:Kolektivno upravljanje pravic je posebnost avtorskega prava. Razvilo se je z namenom izboljšanja pogajalskega položaja avtorjev nasproti uporabnikom njihovih del. S skupinskim nastopom so avtorji lahko zahtevali pravičnejše nadomestilo za uporabo del. Kolektivna oblika upravljanja pravic v določenih primerih predstavlja edini način, preko katerega lahko avtor uveljavi svoje pravice. V razmerah množične in razprostranjene uporabe del je za avtorja lažje in učinkovitejše, da prepusti upravljanje pravic pooblaščeni kolektivni organizaciji in se sam lahko posveti nadaljnjemu avtorskemu ustvarjanju. Na drugi strani je uporabniku olajšana pridobitev dovoljenja za uporabo številnih avtorskih del. Diplomsko delo obravnava spremembe slovenske zakonodaje na področju kolektivnega upravljanja v avtorskem pravu. Od sprejetja prvega Zakona o avtorski in sorodnih pravicah iz leta 1995 do danes je bil zakon noveliran sedemkrat. Največjo spremembo predstavlja konec preteklega leta 2016 sprejet nov zakon, t. i. Zakon o kolektivnem upravljanju avtorske in sorodnih pravic. Nov zakon ločeno obravnava kolektivno upravljanje od drugih vsebin avtorskega prava. Sprejetju novega zakona je med drugim botroval tudi prenos Direktive 2014/26/EU Evropskega parlamenta in Sveta, z dne 26. februarja 2014, o kolektivnem upravljanju avtorske in sorodnih pravic ter izdajanju več ozemeljskih licenc za pravice za glasbena dela za spletno uporabo na notranjem trgu v slovenski pravni red.

Abstract:Collective rights management is a specialty of copyright law. It was developed in order to improve the negotiating position of owners of rights against users of their works. With collective approach the owners of rights could claim a fairer compensation for the use of their works. In certain cases the collective form of rights management represents the only way through which the owners of rights can assert their rights. In the circumstances of mass and widespread use of works, it is easier and more efficient for the owner of rights to leave the management of rights to an authorized collecting society. In this way they can dedicate themselves to further copyright work. On the other hand, it is easier for the user to obtain permission to use a number of copyright works.The diploma thesis deals with changes in Slovenian legislation in the area of collective management and copyright law.Since the adoption of the first Copyright and Related Rights Act from 1995 to date, the law has been amended seven times. The biggest change is the adoption of a new law at the end of the year 2016, the so-called Collective Management of Copyright and Related Rights Act. The new law separately addresses collective management from other copyrights. The adoption of the new law was also supported by, inter alia, the transposition of Directive 2014/26/EU of the European Parliament and of the Council of 26 February 2014 on collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market into the Slovenian legal order.
