Title:Kolektivna pogajanja in kolektivna pogodba : diplomsko delo

Abstract:Dandanes v svetu velja, da so kolektivne pogodbe v demokratičnih državah s tržnim gospodarstvom učinkovito sredstvo za urejanje delovnih pogojev ter razmerij med socialnimi partnerji, ki med drugim omogočajo urejanje področij, ki niso urejena v okviru Zakona o delovnih razmerjih, pri čemer so razvojno gledano rezultat pravice delavcev do sindikalnega združevanja, ki je temeljna pravica svobode delovanja sindikatov.Zaradi hitro rastočega gospodarskega razvoja in večje konkurenčnosti je pravica do kolektivnega pogajanja pomemben vidik socialnih partnerjev za predstavljanje in doseganje svojih zahtev ter še kako pomembna za uravnotežen in skladen razvoj trga dela, urejanje konfliktnih ekonomsko-socialnih razmerij, vzpostavljanje socialnega miru ter krepitev splošne demokratične ravni v družbi in posamezni državi, katere cilj je tudi socialni dialog. S socialnim dialogom ustvarjamo temeljno komunikacijo v družbeni skupnosti, kar vodi k razvoju svobode, varnosti in človeškega dostojanstva. V tem je izredno pomembno tudi delo socialnih partnerjev,ki je uspešneje, kolikor bolj so izenačeni z realno močjo, pri čemer je ključnega pomena za kakovosten socialni dialog njihovo medsebojno spoštovanje, ki je pomemben element za enakopravno varovanje interesov delavcev v kolektivnih pogajanjih, še posebej v času krize, ki nas bo spremljala še vrsto let in je največji izziv za medsebojne odnose. V diplomskem delu se osredotočamo na varovanje interesov vseh socialnih partnerjev, katerega temelj je socialni dialog, pri tem pa skušamo skozi zakonitosti procesa kolektivnih pogajanj in njegovih značilnosti spoznavati temeljne značilnosti kolektivne pogodbe pri nas in v Nemčiji, Italiji ter Avstriji, pri čemer nas zanima tudi pomen zakonskih temeljev za zagotavljanje kakovostnega socialnega dialoga.

Abstract:Nowadays, it is recognized in the world that collective agreements in the democratic countries with a market economy are efficient means for settling working conditions and relationships between social partners, which, among others, enable settlingthe fields which are not settled within the Employment Relationship Act, where, developmentally speaking, the result is employees' rights to trade unions, which is a basic right of freedom of trade union operations.Due to the rapidgrowth of economic development and increased competition, the right to collective negotiations is an important aspect of social partners in order to present and fulfill their requests. The right is very important for a balanced and harmonious development of the labor market, settling conflicting economic social relationship, establishing social peace, and strengthening the general democratic level in the society and in an individual state, whose goal is also a social dialogue. By means of a social dialogue,we create basic communication in the social community which leads to the development of freedom, safety,and human dignity. In the process, work of social partners is exceptionally important. The latter is more successful if they are equated with the real power, where their mutual respect is essential for a qualitative social dialogue. The mutual respect is an important element for equal protecting of interests of employees in collective negotiations, especially in times of the crisis, which will be present for many more years and is the biggest challenge for mutual relationships. In the diploma thesis, we focus on ascertaining of protecting the interests of all the social partners, whose foundation is a social dialogue. In the process, we try to learn basic characteristics of the collective agreement in Slovenia, Germany, Italy,and Austria through the rules of the process of collective negotiations and their characteristics. We are also interested in the significance of legal foundations in order to ensure a qualitative social dialogue.
