Title:Odškodninska odgovornost za mučenje in drugo kruto, nečloveško ali poniževalno kaznovanje ali ravnanje z obsojencem : magistrsko delo

Abstract:Doslej se odškodninski odgovornosti po 84. členu Zakona o izvrševanju kazenskih sankcij (ZIKS-1) ni posvečalo skoraj nič pozornosti. To preseneča, saj se področje vsekakor kaže za aktualno, še posebej po zdaj že več obsodbah Republike Slovenije (in tudi vrste drugih držav EU) tudi pred Evropskim sodiščem za človekove pravice (ESČP) zaradi kršitve 3. člena EKČP zaradi zaporskih razmer. Če glede odgovornosti države v takšnih primerih načeloma ne ostaja veliko spornega, pa je stanje drugačno glede morebitne neposredne odškodninske odgovornosti povzročitelja škode samega. Povsem zadostno podlago za (tudi) tako odgovornost daje sicer že Ustava Republike Slovenije, vendar pa se pri tem vendarle lahko pojavi več vprašanj tudi v zvezi z ustavno skladnostjo sedanje ureditve - na primer vprašanje enakosti pred zakonom, saj se ZIKS-1 za druge javne uslužbence ne uporablja. V vsakem primeru pa je seveda treba tudi najti odgovor ne samo na vprašanje, ali se po ZIKS-1 lahko neposredno odškodninsko odgovarja za ravnanje, nasprotno prepovedi mučenja, pač pa tudi, kakšno takšno ravnanje sploh lahko (vse) je. Gre za problematiko, pri kateri prihaja do svojevrstnega prepletanja institutov in pojmov tako nacionalnega kot tudi mednarodnega značaja.

Abstract:Up until now almost no attention was being paid to civil liability on the basis of Article 84 of Enforcement of Criminal Sanctions Act (ZIKS-1). That is rather surprising, as this issue presents itself as most current, especially with now already several judgments of the European Court of Human Rights (ECtHR) against the Republic of Slovenia on Article 3 ECHR violations due to prison conditions here. While it may be that in regards to liability of the state in such cases in principle little remains questionable, the state of affairs in regards to possible civil liability of the one responsible for the damageis much different. Asufficient basis for (also) such kind of liability is provided already by the Constitution of the Republic of Slovenia, however several questions can nonetheless emerge asregards constitutional compatibility of the current order - e.g. the question of equality before the lawasZIKS-1 is not applicable for other public servants. However, an answer hasto be found not only to the question whether on the basis of ZIKS-1 one can be held liable for treatment contrary to the prohibition oftorture, but also to the question what can actually constitute such a treatment. In that regard institutes and concepts of national as well as international character intertwine in a quite peculiar way
