Title:Arbitražna rešitev mednarodnega spora na primeru Filipini vs. Kitajska v južnokitajskem morju : magistrsko delo

Abstract:Naloga začenja z definicijo mirnega reševanja mednarodnih sporov in obravnava prepoved uporabe sile kot temeljno načelo mednarodnega prava. Sledi pregled diplomatskih sredstev mirnega reševanja sporov (pogajanja, dobre usluge anketa, mediacija in konciliacija) in predstavitev osnovnih značilnosti arbitraže in Meddržavnega sodišča. Ta del naloge vsebuje tudi dva praktična primera reševanja mednarodnih sporov: primer arbitraže v sporu med Argentino in Čilom v zadevi ožine Beagle in primer reševanja ozemljskega spora med Belize in Gvatemalo. Naloga vsebuje tudi osnovne podatke o Konvenciji ZN o pomorskem mednarodnem pravu (UNCLOS). Nato se naloga osredotoči na primer arbitraže v Južnokitajskem morju. 22. januarja 2013 je Republika Filipini vložila zahtevo za arbitražo proti Ljudski republiki Kitajski po Prilogi VII Konvencije ZN o pomorskem mednarodnem pravu. Arbitraža se nanaša na vlogo zgodovinskih pravic in izvor pomorskih upravičenj v Južnokitajskem morju, status določenih pomorskih dejavnikov v Južnokitajskem morju in vprašanje zakonitosti določenih aktivnosti Kitajske v Južnokitajskem morju, ki jih Filipini označujejo kot kršitev Konvencije ZN o pomorskem mednarodnem pravu. Kitajska je zavzela stališče nepriznavanja in nesodelovanja v postopku. Stalno arbitražno sodišče (PCA) je bilo sekretar postopka. V zadevi arbitraže v Južnokitajskem morju je arbitražni senat 29. oktobra 2015 izdal Odločbo o jurisdikciji in sprejemu pristojnosti in nato Arbitražno odločbo 12. julija 2016.

Abstract:The work starts with a definition of peaceful settlement of international disputes. It discusses the prohibition of the use of force by states, then it provides an overview of diplomatic means for the settlement of disputes (negotiations, good officies, enquiry, mediation and conciliation) and a presentation of the basic features of arbitration and the International Court of Justice. This chapter is followed by the pratical example of the Dispute between Argentina and Chile concerning the Beagle Channel and the example of Belizean-Guatemalan territorial dispute. The work also provides basic information about the UN Convention on the Law of the Sea (UNCLOS). Then the work focuses on the South China Sea Arbitration. On 22 January 2013, the Republic of Philippines instituted arbitral proceedings against the People's Republic of China under Annex VII to the UN Convention on the Law of the Sea. The Arbitration concerned the role of historic rights and the sourceof maritime entitlements in the South China Sea, the status of certain maritime features in the South China Sea, and the lawfulness of certain actions by China in the South China Sea that the Philippines alleged to be in violation of the Convention. China adopted a position of non-acceptance and non-participation in the proceedings. The Permanent Court of Arbitration (PCA) served as Registry in this arbitration. In the matter of the South China Sea Arbitration the Arbitral Tribunal rendered Award on Jurisdiction and Admissibility on 29 October 2015, and then the Award on 12 July 2016.
