Title:Pravica do enakega varstva pravic v upravnem postopku : diplomsko delo

Abstract:Enako varstvo pravic je ustavno procesno jamstvo, ki se pred Ustavnim sodiščem Republike Slovenije najpogosteje obravnava. Je zelo daljnosežno, tako v smislu raznovrstnih postopkov, v katerih mora biti zagotovljeno (vsi postopki pred državnimi organi, organi lokalnih skupnosti in nosilci javnih pooblastil, ki odločajo o njegovih pravicah, dolžnostih ali pravnih interesih), kot v smislu procesnih implikacij, ki jih za postopke prinaša. Vsako leto pa se z novimi odločitvami te meje še širijo. Ustavno sodišče je torej pri izgradnji vsebine navedenega ustavnega procesnega jamstva odigralo odločilno vlogo, zato je analiza njegove dosedanje prakse ključnega pomena za razumevanje tega jamstva - tudi v kontekstu upravnega postopka. Pri tem seveda lahko pridejo v poštev ne samo tiste odločitve, ki se nanašajo neposredno nanj, pač pa tudi glede drugih postopkov, kolikor so procesni položaji dovolj podobni. Ker pa gre po ustavi vsakomur tudi pravica do sodnega varstva, je potreben tudi vpogled v stanje na področju prakse rednega sodstva v zvezi z enakim varstvom pravic.

Abstract:Equal protection of rights is a constitutional procedural guarantee, which is most often dealt with by The Constitutional Court of the Republic of Slovenia. It is very far-reaching, both in the sense of various proceedings, in which it must be guaranteed (all proceedings before state authorities, local community authorities and bearers of public authority that decide on someone's rights, duties or legal interests), as well as in the sense of procedural implications that it brings for procedures. And every year these boundaries still expand. The Constitutional Court played a crucial role in defining the content of this constitutional procedural guarantee, therefore analysisof its case law is vital for understanding this guarantee - administrative proceeding included. In this regard of course not only those decisions which apply directly to it are to be taken into consideration, but also those in regard to other proceedings,as long as procedural situations are similar enough. Since according to the Constitution everyone has the right to judicial protection, also needed is insight into state of affairs in the field of case law of regular courts in regard to equal protection of rights.
