Title:Primerjalno pravna analiza zakonodaje Združenih držav Amerike in Evropske unije : pravica do pozabe kot kolizija pravice do zasebnosti in pravice do svobode izražanja

Abstract:Hitri razvoj informacijskih in komunikacijskih tehnologij poudarja vse večjo potrebo po zanesljivi zaščiti osebnih podatkov na spletu. Kot družba v 21. se pri tem soočamo predvsem z izzivi,kako zakonodajno ureditev prilagoditi tako, da bi bila zmožna globalno zaščititi posameznikovo pravico do zasebnosti na spletu. Pravica do pozabe, kot jo definira 17. člen Splošne uredbe o varstvu podatkov v Evropski uniji,predstavlja tako priložnost kot izziv za zaščito posameznikove zasebnosti in osebnih podatkov na spletu. Namen te naloge je predstavitev pravice do pozabe, kot jo definira 17. člen Splošne uredbe o varstvu podatkov in analiza koncepta pravice do zasebnosti, natančneje pravice do pozabe, v okviru sodne prakse in zakonodaje Evropske unije in Združenih držav Amerike. Raziskovalno izhodišče pričujoče magistrske naloge je predpostavka, da pravni sistem Združenih držav Amerike v primeru kolizije pravice do svobode izražanja in pravice do zasebnosti razlaga polje varovane zasebnosti bistveno drugače kot pravni sistem Evropske unije, kar lahko predstavlja bistveno mednarodnopravno nekompatibilnost pravnega varstva zasebnosti in osebnih podatkov med Evropsko unijo in Združenimi državami Amerike.Ta magistrska naloga se tako v svojem jedru ukvarja s primerjalno-pravno analizo sodne prakse in zakonodaje Združenih držav Amerike in sodne prakse in zakonodaje Evropske unije.V nadaljevanju magistrska naloga naslovi tudi implementacijske možnosti globalne pravice do pozabe in bralcu v sklepnem delu ponudi odgovore na mednarodno-pravne izzive obravnavanje v tem delu.

Abstract:Rapid development of the information and communication technologies highlights the growing need for reliable protection of personal data online. As a society in the 21st century, we are faced with the challenges on how to adapt legislation and regulation in such a way, that it would effectively protect the individual's right to privacy in a global online setting. The Right to be Forgotten as defined in Article 17 of the General Data Protection Regulation in the European Union represents both an opportunity and a challenge in a modern quest to protect individuals' privacy and personal data online.The purpose of this master's thesis is to present the right to be forgotten, as defined in Article 17 of the General Data Protection Regulation and in the following sequence, analysis of the concept of the right to privacy in the context of comparative legal analysis of the case-law and the legislation of the European Union and the United States of America. The theoretical starting point of this master's thesis is the assumption that if there is a case of a conflict between of the freedom of expression right (freedom of speech) and the right to privacy, the legal system of the United States defines the field of legitimate and necessary protection of individual's privacy significantly differently than legal system of the European Union. This in turn, can constitute in a challenge of international legal incompatibility between European Union and United States of America.This master's thesis focuses on the comparative and legal analysis of the jurisprudence, case-law and legislation of the United States of America and jurisprudence, the case-law and legislation of the European Union. In the continuation, this master's thesis also addresses the implementation possibilities of the global right to be forgotten and in the concluding part gives the reader some conclusionsto the international-legal challenges dealt with in this thesis.
