Title:Svoboda izražanja v glasbeni umetnosti : magistrsko delo

Abstract:Svoboda izražanja je ena temeljnih pravic, izhajajočih iz človekovega dostojanstva. Ker je človek misleče, duhovno bitje, bi bil brez možnosti, da svobodno, brez omejitev in pritiska, na tak ali drugačen način predstavi svoja stališča in mišljenja, le prazen kalup. Svoboda izražanja ni pomembna zgolj v smislu svobode tiska, temveč je bistvenega pomena za umetniško izražanje, tudi na glasbenem področju. Nemalokrat je namreč že v osnovi cilj določenega glasbenega dela provokacija, šokiranje in vznemirjanje, še toliko bolj v deviantnih glasbenih žanrih, kot so heavy metal, hard rock, punkin rap. Svoboda glasbenega izražanja se med drugim nanaša na: svobodo predvajanja glasbe v javnosti in zasebnosti, svobodo izvajanja glasbe na koncertih in svobodo izdajanja glasbenih albumov, ne glede na to, kaj želijo glasba ali njena besedila izraziti. Proti glasbenim ustvarjalcem torej zaradi njihovih stališč,izraženih skozi glasbo, ni dovoljena uporaba pravnih sredstev, razen v izjemnih primerih, ko glasba,denimo,spodbuja k nasilju in vojni, rasni ali drugi nestrpnosti ali ko je potrebno zavarovati javni red in mir ter moralo, čast in pravice drugih.

Abstract:Freedom of expression is one of the most fundamental rights derived from the very essence of human dignity. Humans are thinking, spiritual beings and if they didnot have the capability to freely express their views, they would simply be a hollow shell. Freedom of expression is not important only in the sense of freedom of press;it is equally important and essential for the freedom of artistic expression, also in the field of music. The goal of a certain musical genre is frequently to provoke, shock, and excite - more so in deviant genres, such as heavy metal, hard rock, punk and rap. Freedom of musical expression applies to: freedom of playing music in public and in private spaces, freedom of performing music in concerts, and freedom of releasing albums no matter what the music and its lyrics mean to express. Therefore, it is not allowed to legally act against musicians because of their views expressed through their music, except in cases when the music calls to war and violence, racial and other discrimination,or when public order, peace, dignity and rights of others need to be protected.
