Title:Mednarodno pravni vidiki ˝odcepitve˝ Krima : magistrsko delo

Abstract:Pisanje obravnava mednarodno pravne vidike odcepitve Krima. Poudarek je na pregledu zgodovinskega dogajanja na območju Krima ter vpletenih državnih tvorb in ljudstev tako iz Evrope kot tudi iz Centralne Azije in z območja Kavkaza. Povzeto je dogajanje od obdobij pred antiko pa vse do leta 2014, ko je bil Krim priključen k Ruski federaciji. Avtor se je tako osredotočil na ključne, aktualne probleme, ki so nastali z razvojem dogodkov v Ukrajini v povezavi z zgodovinskimi dogodki. Ob tem skuša avtor z raziskovanjem zgodovinskih pisanj ter vsakodnevnih poročanj ustvariti sliko dogajanja iz zgodovine v povezavi z današnjimi dogodki, vse skupaj pa utemeljiti v povezavi z razvojem domačega in mednarodnega prava na obravnavanem področju ter ustvarjanjem mnenja na podlagi pravne znanosti. Osredotoča se na pravico do samoodločbe in načela teritorialne integritete ter na njuno kolizijo. Ravno s pomočjo sklicevanja in preučevanja pravnih pisanj skuša pojasniti današnji razvoj dogodkov ter njihovo prihodnost, čemur nameni veliko pozornosti ob opisovanju in primerjavi različnih argumentov. Ob tem izpostavi več primerov samoodločbe iz mednarodne skupnosti, osredotoči pa se na primerjavo.

Abstract:Writing addresses present legal aspects of the secession of the Crimea. The emphasis is on the review of historical events in the territory of Crimea and involved state formations and different peoples from Europe as well as from Central Asia and the Caucasus area. It summarizes the events from the period prior to the antiquity and all the way to 2014, when Crimea was connected to the Russian Federation. The author has also focused on current issues arising from developments in Ukraine linked with historical events. At the same time the author tries to research historical documents and daily reporting to create a picture of historical events associated with today's events, and everything is justified in relation to the development of domestic and international law in the matter and the creation of an opinion on the basis of legal science. It focuses on the right of self determination and the principle of territorial integrity and the collision between them. Indeed, with the help of references and review of legal documents trying to explain today's developments and their future, which pay close attention to the description and comparison of different arguments. At the same time it exposes more cases of self determination from the international community, focusing on the comparison between them.
