Abstract:Čezmejno izvajanje storitev je začasno opravljanje dejavnosti delodajalca ali tujega delodajalca z napotitvijo delavcev na delo na podlagi ohranjene vključitve v ustrezna socialna zavarovanja v državi članici EU, kjer ima delodajalec sedež ali prebivališče. Področje urejajo uredbe in direktive EU, zaradi vse večjih zlorab, ki so se pojavile v zadnjem času, pa se Vlada trudi opredeliti zadevno problematiko tudi z nacionalno zakonodajo. Diploma se ukvarja z vprašanjem, ali je to smiselno in skladno s pravom EU ter z obravnavo problematike na tem področju.

Abstract:Cross-border provision of services is a temporary performarce of activities of an employer or a foreign employer with posting of workers and by maintaining the inclusion of workers in the social insurances in the member state of EU, in which the employer has his registered office or residence. This is regulated by regulations and directives of EU, but because of the rising abuse, the government is trying to regulate the problem with national legislation. My diploma deals with the question if this is needed and consistent with the EU legislation and also addresses the issues in this area.
