Title:Imisije : diplomsko delo

Abstract:Institut imisij je sosedsko pravni institut, ki v večji meri hkrati ščiti in omejuje lastninsko pravico, v manjši meri pa varuje okolje. Temelj najdemo v Stvarnopravnem zakoniku (SPZ), ki v 73. členu določa generalno klavzulo o prepovedi medsebojnega vznemirjanja. Prepovedane imisije pa opredeljuje 75. člen SPZ. Imisijsko varstvo je možno na dva načina, in sicer ločimo stvarnopravno varstvo, ki se uveljavlja preko negatorne tožbe (99. člen SPZ) in obligacijsko pravno varstvo, ki se uveljavlja preko popularne tožbe (133. člen OZ). Diplomsko delo je zastavljeno na način, da najprej predstavi teoretičen vidik (splošna ureditev, delitev imisij, ureditev v ZTLR, SPZ, OZ, imisijsko varstvo), to pa nadgradi z analizo sodne prakse, ki je zaradi lažje preglednosti oblikovana v več kategorij (odvodnjavanje; postavitev ograj, zidov, ki rezultirajo v negativnih vplivih; dim, hrup; veje, ki segajo v zračni prostor soseda, in ostalo, ki je neuvrščeno v druge kategorije). Analiza sodne prakse višjih sodišč je pokazala, da je pred slovenskimi sodišči zelo veliko primerov imisijskih zahtevkov, kar posledično pomeni, da imamo zelo bogato sodno prakso, ki pa v bistvenem ne odstopa od teorije. Velik problem v praksi (česar se zaveda tudi teorija) predstavlja oblikovanje imisijskega zahtevka, ki mora biti ravno prav konkreten, da je hkrati izvršljiv in da ne posega pregrobo v lastninsko pravico.

Abstract:The institute of immissions is a neighborhood's law institute that mostly restricts and protects the ownership rights and, to a lesser extent, the environment. It is based in Stvarnopravni zakonik (SPZ), its 73. article determining the general clause regardingthe prohibition of mutual disturbances. The forbidden immissions are defined by the 75. article of SPZ. The immissions policy is divided into the property law that is enforced by the actio negatoria (99. article SPZ), and the contract legislation that is enforced by the actio popularis (133. article OZ). I've constructed my thesis so that it firstly describes the theoretical aspect (the general regime, the effort sharing in immissions reductions, the arrangements in ZTLR, SPZ, OZ, the immissions policy), and later on focuses on the analysis of the case-law, divided into subcategories (draining capacity; building of fences and walls which result in negative influences; smoke, noise; branches extending into the neighbour country's airspace and others that can't be put into any other categories). The analysis of the case-law of Slovene higher courts showed that there are numerous immission claim cases which resultsin a rich case-law that does not deviate significantly from the theory. A great problem of its practice (of which the theory is aware) is the balancing of the immissions claims which has to be at the same time enforceable and must not interfere too harsh with property rights.
