Title:Politika in etika ob koncu življenja : magistrsko delo

Abstract:Magistrsko delo obravnava posebnost položaja pri pacientu ob koncu življenja. Uvodoma smo pojasnili temeljna vprašanja življenja in smrti, s katerimi se umirajoči v svojem zadnjem obdobju življenja običajno sooča. V okviru prve zastavljene hipoteze in raziskovalnih vprašanj smo opredelili pojem "oseba" in raznolika pojmovanja vrednosti človeškega življenja. Ugotavljali smo predvsem, ali ima vsako človeško življenje enako vrednost oz. ali so lahko v posebnih primerih določena človeška življenja vredna več kakor druga. Nadalje smo v okviru druge hipoteze in raziskovalnih vprašanj raziskovali, kje je meja in kaj ustvarja moralno razliko med povzročiti smrt in pustiti umreti. Glede navedenega smo za eno in isto dejanje predstavili različne interpretacije etičnosti ravnanja. V nadaljevanju smo na podlagi tretje hipoteze in raziskovalnih vprašanj primerjali Etična priporočila za odločanje o zdravljenju in paliativni oskrbi, sprejeta v Sloveniji, s Smernicami Sveta Evrope o medicinskih odločitvah ob koncu življenja. Preučili smo navedene dokumente, saj smo želeli ugotoviti, ali so priporočila skladna z omenjenimi smernicami, hkrati smo izpostavili bistvene elemente obeh dokumentov. V okviru zadnje hipoteze pa smo posebej obravnavali pomen vnaprej izražene volje, saj gre za relativno nov institut, ki lahko igra pomembno vlogo pri pacientu ob koncu življenja, ker odraža svobodo odločanja. Hkrati smo prikazali različne pravne ureditve vnaprej izražene volje v desetih evropskih državah. Posebej smo poudarili pomen napredka medicine, ki nas prisili, da razmišljamo o vprašanjih, s katerimi se nam v preteklosti ni bilo treba soočati, npr. do kdaj je smiselno podaljševanje življenja umirajočega brez možnosti ozdravitve. V osrednjem delu magistrskega dela smo prikazali pomen medicinskih odločitev ob koncu življenja in pomen etičnosti ravnanja v tovrstnih primerih. Ob tem smo izpostavili tudi pomen dostojanstva pacienta ob koncu življenja. To posebno situacijo ob koncu življenja smo obravnavali tako skozi oči zakonodaje kot etike. Z navedenim delom smo poudarili tako razsežnost kot tudi kompleksnost obravnavane teme. Hkrati želimo spodbuditi stroko k nadaljnjim razpravam, saj živimo v času nenehnih sprememb v razvoju medicine. Želimo pa tudi izpostaviti pomen seznanitve pacienta z njegovimi pravicami v zadnjem obdobju življenja in pomen sprejemanja odločitev z upoštevanjem posebnega položaja, v katerem se pacient nahaja.

Abstract:The master's thesis deals with specificity of situation at the end of life. In introduction we explained basic questions of life and death, with which the dying person usually faces at the last period of their life. Within the first set hypotheses and research questions, we defined a term "person", and diverse concepts of value of human life. We mainly established whether each human life has the same value or whether in specific situations, certain human lives are worth more than others. Further, within the second hypothesis and research questions, we examined where the border is and what creates a moral difference between to cause death and let die. In regard to the stated, for the same action we presented different interpretations of ethical conduct. Further, within the third hypothesis and research questions, we compared Ethical Recommendations for decision-making on treatment and palliative care, adopted in Slovenia, to Council of Europe Guidelines on medical decisions at the end of life. We examined the stated documents, since we wanted to establish whether the recommendations are in accordance with the mentioned guidelines. At the same time, we pointed out the essential elements of both documents. Within the last hypothesis, we separately examined the importance of in advance expressed will, since this is a relatively new institute, which can play an important role in patient at the end of life, because it reflects a freedom of decision-making. At the same time, we presented different legal regulations of in advance expressed will in ten European countries. Specifically, we also emphasized the importance of medical progress that forces us to think of questions that we did not have to deal with in the past, for example when it is sensible to extend a life of the dying person with no possibility of recovery. In the central part of the master's thesis, we presented the importance of medical decisions at the end of life, and the importance of ethical behaviour in these situation. At the same time, we also emphasized the importance of patient's dignity at the end of life. This special situation at the end of life was dealt with through legislation as well as ethics. With the present work we emphasized the extent and complexity of the discussed topic. At the same time, we want to encourage the profession for further discussions, since we live in a period of constant changes in medical development. We also want to point out the importance of familiarization of a patient with their rights in the last period of life, and the importance of decision-making considering a specific situation the patient is in.
