Title:Data protection in EU life sciences : masters thesis

Abstract:This thesis will discuss the topic of data protection in Life Sciences. Describing and analysing will be conducted in parallel with description of respective mechanisms and tools used in data management, such as consent. Thesis will further address flow of personal data, influenced by innovation, economic growth and the digital single market strategy. These factors are essential in maximizing the benefits of data processing in the field Life Sciences of European Union. The focus of my research will be set on data subject and its rights within the scope of the European Union. Data subjects' existence will be described within the scope of clinical trials, pharmacovigilance, "eHealth", "mHealth" iniciative, impacted by the new data protection reform. Data protection is one of the fundamental rights in the European Union. How it can be secured and guaranteed that data subjects' anonymity is intact while delivering a good business practice through data protection strategy and polices, is a multi layered question. The analysis shall address data protection and security measures for collecting, storing and transferring personal data.And lastly, research work will address data privacy maintenance in use of mobile devices for health-related purposes. Benefits of digitalization, suposedly, go far beyond their economic impact, which is what the thesis will be discussing.

Abstract:Magistrska naloga bo obravnavala vprašanje, ali obstoječa zakonodaja na področju varstva podatkov v življenjskih znanostih sledi tehnološkemu napredku in izrablja svoj polni potencijal. Poudarek raziskovalnega dela bo na pravnem subjektu ter njegovih pravicah v okviru pravnih predpisov Evropske Unije. Skozi opisovanje instituta kot je izrecna privolitev, bom poskušala odgovoriti na vprašanje ali varstvo občutljivih osebnih podatkov v Evropski Uniji lahko predstavlja potencial dobrih poslovnih praks na področju življenskih znanostih. Nadalje bo opisan obstoj pravnega subjekta v okviru izvedbe kliničnih preizkušanj, farmakovigilence, "eHelth" iniciative ter "mHealth" iniciative v sklopu sprememb, ki jih prinaša Uredba o varstvu posameznikov pri varovanju, obdelavi ter pretoku osebnih podatkov. Varstvo osebnih podatkov je temeljna pravica pravnih subjektov. Kako jo lahko zagotovimo znotraj okvira Evropske Unije na različnih področjih uporabe, da obenem zagotovimo anonimnost pravnega subjekta in predstavljamo dobro poslovno prakso varstva osebnih podatkov, pa je večplastno vprašanje. Ukrepi za izvajanje varnega zbiranja, shranjevanja in prenosa podatkov bodo del raziskovanja te magistrske naloge. Analizirana bo raven zasebnosti, ki naj bi (idealno) bila sorazmerna namenu zbiranja osebnih podatkov. Pri tem pa je potrebno upoštevati tudi tveganje povezano s procesiranjem občutljivih osebnih podatkov na mobilnih napravah za namene zagotavljanja zadovoljive ravni javnega zdravja. Kar pa prav tako predstavlja izziv za industrijo kot tudi za zakonodajalca.
