Title:Kazenski postopek za mladoletnike : primerjava slovenskega in anglo-ameriškega sistema

Abstract:Mladoletniška delinkvenca je izraz, ki označuje vsa kazniva dejanja mladoletnih oseb; to so osebe v starosti od 14. do 18. leta v slovenskem sistemu ter osebe od 10. do 17. leta oziroma izjemoma do 24. leta v anglo-ameriškem sistemu. Mladoletna oseba je v obeh omenjenih sistemih v kazenskem postopku obravnavana drugače. Gre za osebe, ki izvršijo kazniva dejanja predvsem zato, da bi se izkazali pred vrstniki in širšo družbo ter pridobili statusni položaj. Nerazvit čut za moralo, še ne povsem razvita osebnost in želja po občutku pripadnosti so glavni razlogi, da zunanji dejavniki dokaj hitro vplivajo na izvršitev kaznivega dejanja. Vzgojni ukrepi so tako lahko preventivni ukrepi na poti mladoletnika k izvršitvi kaznivega dejanja. V diplomskem delu sem se osredotočila na primerjavo slovenskega in anglo-ameriškega sistema glede obravnave mladoletnika v kazenskem postopku. V diplomskem delu je podan kratek oris določenih institucij, kot sta slovenski Center za socialno delo (CSD) in angleški program vključevanja mladih v družbo "Youth Inclusion Programme" (YIP). Določen poudarek je namenjen poglavitnima razlikama med sistemoma, in sicer institutu smrtne kazni, ki je do nedavnega v anglo-ameriškem sistemu veljal tudi za mladoletnike, in obravnavi mladoletne osebe kot odrasle osebe v kazenskem postopku, kar v Sloveniji ni mogoče.

Abstract:Juvenile delinquency is a term that describes all offences of juveniles who are defined as young people between the ages of 14 and 18 in the Slovenian law system, and young people between the ages of 10 and 17, or exceptionally to the age of 24 in the Anglo-American common law. In both systems, a minor is treated differently when it comes to criminal proceedings. These are young people who commit a crime, especially in order to prove themselves to their peers and to the society, and to gain status. An unsophisticated moral sense, a personality that is still developing, and the need for a sense of belonging are the main causes that allow the external factors to have an influence on the action of committing a crime. Therefore, punitive-educational measures can be imposed on minors as crime prevention measures. This thesis focuses on the comparison of the Slovenian and the common law systems regarding the treatment of a juvenile in criminal law proceedings. There is also provided a brief outline of certain institutions such as the Social Work Centre in Slovenia and the Youth Inclusion Programme (YIP) in England. A particular emphasis is placed on the main differences between the two systems: the institute of the death penalty, which was used in the common law system for juveniles until recently, and the fact that juveniles can be treated as adults in the criminal law proceedings in common law system, whereas this is not possible in Slovenia.
