Title:Odraz arabske pomladi v ustavnih ureditvah : magistrsko delo

Abstract:Namen magistrskega dela je preučiti povezanost in korelacijo arabske kulture ter tradicije in islamskega prava z dogajanji pred, med in po arabski pomladi ter njihov pozitivni ali negativni vpliv na ustavne in politične sisteme v arabskih in evropskih državah. Pri tem smo podrobneje preučili zgodovinski razvoj arabskih držav in arabsko mentaliteto ter nastanek in pomen islamskega prava, vire islamske tradicije in vrednote v islamskem svetu, vzroke in cilje arabske pomladi ter dogajanje v posameznih arabskih državah in odzive mednarodne skupnosti. V zaključni fazi pa smo primerjali posamezne politične in ustavne sisteme izbranih držav in preverili, na kakšen način sta islam in arabska pomlad nanje vplivala, ter se opredelili do ugotovljenih rezultatov. Arabske države so skozi vso zgodovino tesno povezane z islamom in islamskim načinom življenja. Islam je vpet v ustavna besedila, zakone in običajno pravo. Posledično so tudi ustavne ureditve arabskih držav pod velikim vplivom šeriatskega prava, ki se na določenih področjih precej razlikuje od priznanih mednarodnih in nacionalnih standardov in prava. Posamezne evropske države so vedno bolj v dilemi glede islama, zato tudi vse bolj spremljajo razvoj islamskih skupnosti v svojih državah. V zadnjih desetletjih je bil islam obravnavan v številnih razpravah o ekstremnem nasilju, terorističnih gibanjih, kršitvah človekovih pravic, češ da državljani prisotnost muslimanov težko sprejmejo kot pozitiven dejavnik. Strah, sumničavost in nezaupanje sta velika pred vsem, kar je islamsko. Pred islamom in Evropo je tako izjemno težka naloga priznavanja, spoštovanja in sodelovanja.

Abstract:The purpose of the work is to study the cohesion and correlation of Arab culture, tradition and Islamic law with the events occurred before, during and after the Arab spring and their positive or negative effects on constitutional and political systems in Arab and European countries. In that regard we studied in more detail the history of Arab states, Arab mentality, formation and significance of Islamic law, sources of Islamic tradition, values in Islamic world, causes and goals of Arab spring, events occurred in individual Arab states and responses of international community. In final phase we compared individual political and constitutional systems of selected countries and declared our position towards established findings. The Arab states are closely linked with Islam and Islam way of life through the entire history. Islam was integrated within constitutional texts, laws and general law. Consequentially, the constitutional governments of Arab states are under the high influence of Sharia law, which significantly differs from recognised international and national standards and laws. Individual European states are more and more in dilemma about Islam; therefore they monitor more increasingly the development of Islam communities in their countries. In last decade the Islam was considered in numerous debates on extreme violence, terrorist movements, violation of human rights, therefore the citizens hardly accept the presence of Muslims as positive factor. Fear, suspiciousness and distrust are great against everything that is Islamic. In front of Islam and Europe is extremely difficult task of recognition, respect and collaboration.
