Title:Surogacija in potreba po mednarodnopravni ureditvi : magistrsko delo

Abstract:Surogacija ali nadomestno materinstvo je posebna oblika starševstva, pri katerem nadomestna mati s postopki oploditve z biomedicinsko pomočjo zanosi, nosi in rodi otroka in ga po rojstvu izroči nameravanim staršem ter se odpove vsem pravicam in obveznostim do tega otroka. Institut dovoljujejo le države z liberalno zakonodajno ureditvijo, medtem ko večina evropskih držav nadomestno materinstvo v celoti ali delno prepoveduje. Koncept družinske skupnosti se spreminja in prilagaja družbeni realnosti, zato so države primorane hote ali nehote slediti globalnim trendom. Tehnološki napredek omogoča neplodnim parom, da postanejo starši s pomočjo surogacije. Zaradi različne zakonodajne urejenosti v evropskem in mednarodnem okolju se nameravani starši srečujejo s težavami pri priznavanju starševskih, otrokovih in drugih pravic, pridobljenih na podlagi pogodbe o nadomestnem materinstvu. S pojavom čezmejnega nadomestnega materinstva, ko nameravani starši poiščejo nadomestno mater v tujini, so težave zaradi odsotnosti mednarodnopravnega akta, ki izhajajo iz dogovorov o nadomestnem materinstvu za udeležence dogovora in države, ki takšen institut prepovedujejo, še večje. Na podlagi proučene literature, zakonodajne ureditve evropskih in drugih držav ter mednarodne in nacionalne sodne prakse s področja surogacije ugotavljam,ali je surogacijo treba mednarodnopravno urediti in katere temeljne pravne norme bi morali v ureditvi upoštevati.

Abstract:A surrogacy arrangement or surrogacy agreement is a special form of parenting in which the surrogate mother, with the help of assisted reproductive techniques, bears and delivers a child for the intended parents and renounces all rights and obligations to that child. Surrogacy is permitted only in countries with a liberal legislative regime, while in most European countries it is partially prohibited or prohibited in complete. The concept of the family unit is changingand adapting to social reality, thus countries are willingly or unwillingly being forced to follow global trends. Technological progress allows infertile couples to become parents through surrogacy. Due to various legislative regulation inthe European and international environment, the intended parents are facing difficulties in recognizing the parental, child and other rights acquired under surrogate contract. With the rise of cross-border surrogacy, when the intended parents find a surrogate mother abroad and in the absence of international regulation, the issues of surrogacy, resulting from agreements on surrogacy for participants in such an arrangement and countries that prohibit it, are even greater. Based on the examined literature, European legal system and legal system of other countries, international and national judicial practicein the field of surrogacy, I try to determine if surrogacy needs to be internationally regulated and which fundamental legal norms should be taken in considerationin the regulation.
