Title:Ustavnopravni vidiki uporabe videokonferenčnega sistema v sodnih postopkih : magistrsko delo

Abstract:V okviru navodil Sveta Evrope je bil v Sloveniji leta 2011 uveden videokonferenčni sistem v pravosodju, ki predstavlja pomembno pridobitev za delovanje slovenskih sodišč. Ministrstvo za pravosodje je postavilo videokonferenčno opremo v enajstih razpravnih dvoranah okrožnih sodišč in enajstih centrih za socialno delo. Uporaba videokonferenčnega sistema ima pomembno vlogo zlasti pri zaslišanju otrok, žrtev spolnega ali drugega nasilja, skritih ter anonimnih prič ter oseb, ki zaradi različnih objektivnih ali subjektivnih okoliščin ne morejo priti na sodišče. Videokonferenco je mogoče izvesti v vseh fazah sodnega postopka, tako v kazenskih kot v civilnih zadevah.Izvajanje dokazov med državami članicami EU je urejeno z enotnimi evropskimi standardi, ki poenostavljajo in pospešujejo postopek izvedbe dokazov v drugi državi članici in s tem omogočajo uresničevanje pravice posameznika do učinkovitega sodnega varstva ter dostopa do sodišča. Osrednji in najpomembnejši del vseh sodnih postopkov je izvajanje dokazov. Sodišče sicer samo presodi, katere dokaze bo izvedlo, vendar pa mora strankam zagotoviti enakopravno obravnavo in spoštovanje človekovih pravic in temeljnih svoboščin.Načelo enakega varstva pravic strank pomeni dolžnost sodišča, da varuje procesne pravice strank in drugih udeležencev ter jih opozarja nanje. Zahteva za "enakost orožij", to je za takšno ureditev in vodenje pravdnega postopka, ki zagotavlja enakopraven položaj strank, je najpomembnejši izraz pravice do enakega varstva pravic pred sodiščem, kot jo opredeljuje 22. člen Ustave RS.V kazenskem postopku so procesna jamstva ustavna kategorija in kot taka ena od temeljnih človekovih pravic in svoboščin. Po 29. členu Ustave RS mora biti vsakomur, ki je obdolžen kaznivega dejanja, ob popolni enakopravnosti zagotovljena pravica, da ima primeren čas in možnosti za pripravo svoje obrambe ter za njeno učinkovito izvajanje.

Abstract:In Slovenian justice system, the videoconferencing was introduced in 2011, as a result of the recommendations of the Council of Europe and represented an important asset for the Slovenian courts. The Ministry of Justice assured videoconferencing equipment in eleven district courts and eleven centres for social services. Use of the videoconferencing system plays particularly important role in the hearing of child, who have been victims of sexual violence, or hidden and anonymous witnesses and persons who, due to various objective or subjective circumstances, cannot come to court. The videoconference can take place at all stages of the judicial procedure, both in criminal and in civil matters. The taking of evidence is governed among EU Member States by uniform European standards thatsimplify and accelerate the taking of evidence in another Member State and thereby facilitate the exercise of an individual's right to effective judicial protection and access to court.The central and most important part of all judicial proceedings is the taking of evidence. The Court decides what evidence it will take, but it must also guarantee the equal treatment of all parties and respect for human rights and fundamental freedoms.The principle of equal protection of the rights of the parties means, that the Court must protect the procedural rights of the parties and other participants and draw their attention to them. Requests for "equality of arms", which refers to arrangements and management of civil procedure and ensures equality of all parties is an important expression of the right to equal protection of rights before the Court of Justice as defined by Article 22 of the Constitution. In criminal proceedings, the procedural guarantees are a constitutional category, since they represent one of the fundamental human rights and freedoms. According to the Article 29 of the Constitution of the Republic of Slovenia, any person who is charged with a criminal offence shall have guaranteed adequate time and facilities for the preparation of his defence and its effective implementation.
