Title:Pravni in etični vidik splava in pokopa splavljenih otrok : magistrsko delo

Abstract:Magistrsko delo obravnava pravni in etični vidik splava oziroma umetne prekinitve nosečnosti in pokopa splavljenih otrok. Splav in umetna prekinitev nosečnosti sta tudi dandanes med najobčutljivejšimi in osebnimi temami, tako doma kot tudi po svetu. Oba medicinska postopka za večino žensk lahko pomenita prelomni trenutek in na njih lahko pustita psihične in fizične posledice. Splav in umetna prekinitev nosečnosti sta v različnih državah različno obravnavana - od stroge prepovedi do popolne svobode pri odločanju. V prvem delu so s pomočjo teoretičnih izhodišč obrazloženi pojmi življenje, splav, umetna prekinitev nosečnosti, nedovoljena umetna prekinitev nosečnosti in mrtvorojenost. V nadaljevanju sledita pregled in opis pravne ureditve umetne prekinitve nosečnosti v Republiki Sloveniji in po svetu; predstavljena sta tudi dva primera sodne prakse Evropskega sodišča za človekove pravice. V drugem, teoretično-analitičnem sklopu so zajeta poglavja o splavu in umetni prekinitvi nosečnosti ter medicinski stroki, religiji in posamezniku. Predstavljene so izkušnje mamic, ki so doživele splav oziroma umetno prekinitev nosečnosti, pravice staršev ob smrti otroka in pravice umrlih otrok ter pravice do pokopa splavljenih in prezgodaj rojenih otrok, v nadaljevanju pa, kako je pri nas urejena pomoč ženskam oziroma staršem pred in med umetno prekinitvijo nosečnosti oziroma splavom in/ali po njima. V tem delu so predstavljeni tudi rezultati ankete, izvedene v slovenskih porodnišnicah, ter delno strukturirani intervjuji, opravljeni s posameznicami z lastno izkušnjo splava oziroma umetne prekinitve nosečnosti ter s predstavnicami zavodov in društev, ki nudijo pomoč ob umetni prekinitvi nosečnosti oziroma splavu. Na tej podlagi sta bili preverjeni in potrjeni tudi obe postavljeni hipotezi.V zaključnem sklopu magistrskega dela so podani odgovori na zastavljeni raziskovalni vprašanji, iz izhajajočih dejstev pa so povzeta pomembna spoznanja. Ključni prispevek k znanosti in stroki pa dajeta analitični del drugega sklopa in zaključni sklop.

Abstract:The master's degree examines the legal and ethical aspectof the abortion or artificial termination of pregnancy, consequently also the burial of aborted children. Even to these days abortion and artificial termination of pregnancy are one of the most sensitive and personal topics worldwide. Both medical procedures are for most women the key moment that leaves physical and psychological scars. Moreover, abortion and artificial termination of pregnancy are treated differently in different countries -from strict prohibition to the freedom of choice. The first part of my master's degree explains the concepts of life, abortion, artificial termination of pregnancy, unauthorized termination of pregnancy and stillborn children through theory. In continuation there is an overview and the description of the legal regulation of artificial termination of pregnancy in Slovenia and through the world; moreover, two examples of legal practice of European Court of Justice for Human Rights are presented. The second part is theoretical and analytical and it comprises chapters on abortion and artificial termination of pregnancy, medicine, religion and individual. Furthermore, I present the experiences of mothers who have gone through the abortion or artificial termination of pregnancy, parents' rights at child's death, the dead children's rights and the right to the burial of aborted or prematurely born children. Continued by the help that women or parents get before and between the artificial termination of pregnancy or abortion. I also presentthe results of the survey carried out in Slovene hospitals and partly structured interviews with women with personal experience of abortion or artificial termination of pregnancy and with representatives of institutions that offer help at artificial termination of pregnancy or abortion. Both hypotheses have been confirmed and proven.The answers to the research questions are given in the final part of my master's degree and important findings are summarized from the facts given. However, the key contribution to the science and profession is given in the analytical and the final part of the master's degree.
