Title:Značilnosti nordijske pravne družine v primerjavi s srednjeevropsko pravno družino : magistrsko delo

Abstract:Vsaka država ima svoj pravni red, pravni redi posameznih držav pa se razlikujejo med seboj. Razlogov za takšno razlikovanje je ogromno. Posamezni pravni redi so nastali iz različnih korenin, podvrženi so bili raznolikemu zgodovinskemu razvoju in nanje so vplivale različne kulturne, družbene, verske in druge okoliščine. Kot vsa znanstvena področja je tudi področje prava predmet znanstvenega raziskovanja. Pomembna panoga znanstvenega in akademskega pristopa k preučevanju prava je primerjalno pravo, ki temelji,kot že beseda sama pove,na primerjavi različnih %prav% oziroma pravnih redov med seboj. Kot vsako znanstveno področje ima tudi primerjalno pravo svojo sistemizacijo, svoja izhodišča in pristope.Obravnavano področje magistrskega dela, ki je pred nami, spada v primerjalno pravno panogo. Ker je le-ta preširoka in obsega zelo veliko vsebin, se to delo izrecno posveti le primerjavi med dvema konkretnima pravnima poddružinama v okviru ene pravne družine. Rimsko-germanska pravna družina je srednjeevropskim bralcem najbližja. Srednjeevropska pravna družina nam je še posebej blizu, saj vanjo uvrščamo tudi slovenski pravni red, nordijska pravna družina tistim malo bolje strokovno podkovanim tudi gotovo ni tuja.Skupen in deloma različen zgodovinskih razvoj teh dveh pravnih poddružin je osrednja točka začetnih poglavji tega magistrskega dela, v nadaljevanju so predstavljena in primerjalno pravno opredeljena posamezna pravna področja. Posebej so izpostavljeni pojavi in instituti, ki so pomembni pri opisovanju razlik med obema poddružinama.Magistrsko delo je pisano ob upoštevanju zgodovine s pogledom usmerjenim v prihodnost, skupno prihodnost obeh omenjenih poddružin v skupnem evropskem prostoru. Primerjava je na mestu, saj je, kot je poudarjeno v zaključnih poglavjih, primerjalno pravo živo in prinaša številne koristi za sodobne pravnike akademike a še toliko bolj za pravnike v praksi, ki s pisanjem sodb in zakonov sooblikujejo zgodovino Evrope.

Abstract:Every country has its own legal system, legal systems of individual countries are very different from each other. There are many reasons for such diversity. Legal systems developed from different roots and were influenced by various historical, cultural, social, religious and other circumstances. Every area of science can become a subject of scientific research, this is true also for the area of law. Comparative law plays an important role in the scientific and academic approach to legal studies, even as the word itself suggests that comparative law is all about comparing individual legal systems. And so as every scientific area even comparative law has its own systemization, its own starting points and approaches. The subject of this work is part of the discipline of comparative law. Comparative law is a very broad area andcontains many various fields and subjects, therefore this work expressly deals with a single comparison of two specific legal subfamilies. The central European and the Nordic legal family that both belong to the romano-germanic legal family. The romano-germanic legal family is very close to European readers. The central European legal subfamily is very close to usbecause Slovenian legal system is part of it. The Nordic legal subfamily is also not unknown at least to those who have some professional knowledge of this subject.The common and partly different historical development of the mentioned subfamilies is a central theme of the beginning chapters of this work. Individual legal areas and institutes that are crucial for the description of differences between the two families are presented in the following chapters. This work is written with history being taken into consideration but still future remains the main focus, namely the common future of both mentioned subfamilies in the common European space. The comparison is vital because as stated in the closing chapters comparative law is alive and keeps bringing many positive aspects to present day academic lawyers as well as lawyers who serve law by writing judgments and new legal documents and this way help create the modern history of Europe.
