Title:Prijetje storilcev kaznivih dejanj v objektih - operativna in pravna izhodišča specialne enote

Abstract:V magistrskem deluje prikazana pot Specialne enote od njenih začetkov do danes, razumevanje pojma specialna enota ter organiziranost, ki se je skozi obdobja spreminjala. Poznavanje zgodovine je pomembno za prihodnji razvoj in izboljšave na vseh področjih dela,v katere je Specialna enota vključena. Predstavljena je zakonska podlaga za njeno delovanje ter njena primerjava s sorodnimi tujimi enotami, kjer sta predstavljeni nemška zvezna in deželna enota. V nadaljevanju je opisana zakonska podlaga za izvedbo dveh policijskih pooblastil, ki s svojimi dejanji posegata v ustavno zavarovane dobrine. To sta prijetje oziroma začasna omejitev gibanja in vstop v stanovanje. Oba termina,sta povezana z osebno svobodo in nedotakljivostjo posameznega subjekta, zaradi česar je nazorno prikazana pravna podlaga in način izvedbe posameznega policijskega pooblastila ter njuna primerjava z zakonodajo Zvezne Republike Nemčije.Ugotavlja se, da je normativno pravna ureditev prijetja in vstopa v stanovanje v RS primerljiva z Zvezno Republiko Nemčijo.Skozi nalogo se sprehodimo skozi proces usposabljanja pripadnikov Specialne enote, njihovo osebno opremo, opremo, potrebno za izvedbo naloge, ki je pogojena z vstopom v objekt ter predstavljene težave, ki spremljajo enoto pri nakupu posameznih tehničnih sredstev. S konkretnim podajanjem in navajanjem dejstev skozi celotno nalogo potrjujem postavljene hipoteze, ki govorijo o primerni opremljenosti in usposobljenosti pripadnikov Specialne enote ter o sorazmernosti uporabe policijskega pooblastila začasna omejitev gibanja.

Title:Prijetje storilcev kaznivih dejanj v objektih
Abstract:The masters degree thesis presents the historical path of the special unit from its beginnings until today, understanding the meaning of the term special unit and its organization which has been changing throughout different periods. The knowledge history is important for future development and improvements on all special unit fields of work. Thesis presents the legal basis for its work and the comparison with similar foreign units likeGerman federal and state unit.Further on we can see the legal basis for execution of two police power regulations which affect constitutionally protected goods. We are talking about arrest and entry. Both terms, arrest and entry, are connected to personal freedom and integrity of an individual subject which is why legal basis and methods of implementation of individual police power and its comparison with legislation of Federal Republic of Germany are clearly shown. We can see that the legal regulation of arrest and entry in Slovenia is comparable with the regulation of the Federal Republic of Germany. In the masters degree thesis we walk through the special unit police officers' training process, their personal protective equipment and the equipment necessary to carry out tasks which include entry into the facility as well as problems which the unit faces regarding the purchase of the individual technical resources. With a concrete explanation and stating the facts through the whole thesis I am verifying and confirming the hypotheses which talk about adequate level of equipment and qualification of special unit officers and the proportion of the use of temporary restriction of movement police power.
