Title:Manjšinska politika Evropske Unije in Sveta Evrope : magistrsko delo

Abstract:Magistrsko delo obravnava manjšinsko politiko v Evropski Uniji (v nadaljevanju EU) in v Svetu Evrope (v nadaljevanju SE). Preko teoretičnih izhodišč in predpostavk ter analize primerov smo dokazali, da manjšinska politika EU in SE ne temelji na nedvoumnih in jasnih normah, ki bi jih morale države članice spoštovati na področju varstva manjšin. V Evropi zaradi tega ni celovitega manjšinskega varstva. Manjšinska politika je v državah članicah deležna različne razlage, kar omogoča različen pristop do manjšinskega varstva na vseh področjih. V Evropi je še vedno problem, kako vsem ljudem, posameznikom in skupinam, zagotoviti dejansko enakost ne glede na narodnostno ali etnično poreklo, jezik in vero. Nerešena manjšinska vprašanja lahko povzročijo konfliktne situacije in resno ogrozijo varnost in mir. Ravno nevarnost destabilizacije miru je povzročila, da države težijo k temu, da postanejo mesto za dogovarjanje in reševanje sporov v zvezi z manjšinami. Današnji številni migracijski tokovi, ki prihajajo v Evropo, bodo v prihodnosti spremenili sestavo prebivalstva v Evropi. Tudi zaradi tega mora manjšinska politika vsebovati jasne in nedvoumne norme, ki narekujejo njeno izvajanje in spoštovanje. Države članice bodo morale do te problematike pristopati na enak način, da ne bo prihajalo do razhajanj v zaščiti manjšin na evropskih tleh.

Abstract:The following Master's thesis discusses the minority policy of the European Union (hereinafter EU) and the Council of Europe (hereinafter CoE). Through theoretical bases, assumptions and case analysis, we proved, that the minority policy of the EU and the CoE is not based on unequivocal and clearnorms, which the Member States should respect in the field of the protection of minorities. Consequently Europe does not have a comprehensive minority protection. The minority policy is subject to different interpretations in the Member States, allowing for different approaches to minority protection in all areas. Ensuring effective equality for all people, individuals and groups, regardless of their nationality or ethnicity, remains an issue in Europe. Unsolved minority issues can lead to conflicting situations and pose a serious threat to peace and security. It is this risk of destabilisation of peace that led the countries to strive to become a place for negotiations and settling disputes concerning minorities. The migratory flows arriving in Europe todaywill change the composition of Europe's population in the future. In light of this, the minority policy must contain clear and unequivocal norms that dictate its implementation and compliance. The Member States will have to approach this problem in thesame way, in order to avoid divergences in the protection of minorities on European soil.
