Abstract:V diplomski nalogi je predstavljen potek dokazovanja v kazenskem postopku v Sloveniji, s poudarkom na načelih dokazovanja, dokaznih sredstvih, izločanju nezakonitih dokazov ter sankcioniranju kršitev. Kazenski postopek je obremenjen z nerazrešljivim protislovjem, saj želi na kontradiktoren način priti do resnice. Potrebno je poudariti, da ima kazenski postopek za javnost ogromen simbolni pomen, saj preko pravičnosti kazenskega postopka javnost doživlja pravnost svoje države in vladavino prava v njej. Dokazovanje je zahtevno procesnopravno opravilo, saj združuje uporabo dejanskih ugotovitev in pravnih norm ter obsega zbiranje, izpeljavo in presojo dokazov. Dokazovanje je eno izmed ključnih dejanj celotnega kazenskega postopka, zato je zelo pomembno, da so vsi dokazi pridobljeni zakonito ter da pri odkrivanju kaznivih dejanj ni prišlo do kršenja človekovih pravic.

Abstract:The diploma paper presents the course of evidence in criminal proceedings in Slovenia, with an emphasis on the principles of proof, evidence, the elimination of illegal evidence and the sanctioning of violations. The criminal procedure is burdened with an irreparable contradiction, as it wants to come to a truth in contradictory way. The criminal procedure for the public has a huge symbolic significance, because through the fairness of the criminal procedure the public is experiencing the law of its state and the rule of law in it. Demonstration is a complex process of law enforcement, as it combines the use of factual findings and legal norms and encompasses the collection, derogation and assessment of evidence. Demonstration is one of the key acts of the entire criminal procedure. All evidence must be acquired legally and human rights violations must not been detected.
