Title:Gradnja slovenskih avtocest kot primer zmanjševanja konkurence in oškodovanja državnega proračuna : magistrsko delo

Abstract:Magistrsko delo obravnava gradnjo slovenskih avtocest kot primer zmanjševanja konkurence in s tem oškodovanje državnega proračuna. Zgodba se je pojavila v javnosti leta 2010, ko jo je objavil časnik Finance z naslovom Zemonski sporazum. Medijsko spremljanje dogajanja v zvezi Zemonskega sporazuma slovenskih gradbincev me je napeljalo na idejo, da temo podrobneje preučim in predstavim v magistrskem delu. Skozi delo je predstavljeno področje omejevanja konkurence pri javnem naročanju, kot tudi javno naročanje skozi obdobje gradnje slovenskih avtocest. Predstavljena je tudi sedaj veljavna zakonodaja na področju omejevanja konkurence in javnega naročanja, v kateri so predstavljene bistvene spremembe v primerjavi s staro zakonodajo. Predstavljena je zakonodaja in organi, kateri se ukvarjajo na področja omejevanja konkurence in javnega naročanja v Nemčiji, Avstriji in Hrvaški. Empirična analiza pa zajema samo gradnjo slovenskih avtocest v obdobju od 1994 do 2016, ko je bila intenzivnost del največja, prav tako pa se je v tem obdobju zgodila tudi afera v zvezi dogovarjanja slovenskih gradbincev pri gradnji slovenskih avtocest. Večina del pri gradnji avtocest v Sloveniji pa se je zaključila nekje v letu 2010 z nastankom svetovne gospodarske krize. Sledili so še projekti manjših vrednosti, še največji je bil predor Markovec, ki je bil zaključen leta 2015. V sami analizi so najprej predstavljena gradbena podjetja, katera so bila vključena v omejevalna ravnanja. Predstavljen je Nacionalni program o izgradnji avtocest, na podlagi katerega je potekala gradnja avtocest. Nato pa so analizirani javni razpisi in aneksi k pogodbam, katerih podatke sem pridobil od podjetja DARS d.d.. Posebej je predstavljena analiza izbranih gradbenih podjetij izbranih na javnih razpisih. Vključena je tudi primerjava gradnje slovenskih avtocest z gradnjo v nekaterih evropskih državah. Opisan je postopek, katerega so zoper udeležence Zemonskega sporazuma vodili slovenski organi pregona. Predstavljena je analiza postopkov Urada za varstvo konkurence in Javne agencije RS za varstvo konkurence in Nemškega zveznega urada za zaščito trga, katere sta vodila v zvezi omejevanja konkurence. V zaključku pa so podani predlogi, ki bi pripomogli k preprečevanju omejevanja konkurence pri javnih razpisih in s tem posledično oškodovanja državnega proračuna.

Abstract:The primary aim of this thesis is to discuss motorway construction in Slovenia in order to reduce competition and thus deficit to the state budget. The story appeared in 2010 in Finance newspaper's article titled "Zemonski sporazum" ("The Zemon Treaty"). The Zemon Treaty of Slovenian builders received a lot of attention from the media, which persuaded me to research and present the subject in my master's thesis. The thesis examines how to limit competition when it comes to public procurement (including the procurement during motorway construction in Slovenia). It also examines the legislation in force concerning competition and public procurement restraints by comparing it with no longer enforced laws. It presents the legislations and bodies dealing with limiting competition and public procurement in Germany, Austria, and Croatia. However, the empirical analysis includes only motorway construction in Slovenia between 1994 and 2016, during which period the construction intensity was at its peak. During that time, the scandal regarding Slovene builders' negotiations took place as well. In Slovenia, the majority of works on the motorways ended around 2010 with the beginning of the recession. Some minor projects followed, the most extensive of which being the Markovec Tunnel, finished in 2015. The analysis addresses the construction companies involved in restrictive policies. The thesis also presents the National Motorway Construction Programme upon which the actual construction was based. It furthermore analyses several tenders and annexes (addendums to contracts) acquired from DARS d. d. Additionally, the thesis involves the analyses of some construction companies chosen from public tenders. It also includes the comparison between motorway construction in Slovenia and other European countries. It describes the proceedings led against the partakers in the aforementioned affair by Slovenian law enforcement bodies. This is furthermore supported by the analysis of the proceedings conducted by Slovenian Competition Protection Agency and German Federal Cartel Office. The two can be considered authorities in relation to limiting competition. The conclusion provides some suggestions that would help prevent limiting competition when it comes to public tenders and therefore avoid deficit to the state budget.
